  • Tourist Visa -Child with Divorce Parent

    Looking to get my Neice to the US for a couple of months, who will be travelling with her Grand Parents. Her Mom is divorced with custody of the child as per the Divorce agreement and does not have a US Visa. I had a few qns regarding the application for the Visa, would be great if people familiar with the mater can clarify.

    1) In DS160 do we need to fill her Father details? Or could I just tick- Do Not Know.

    2) who has to accompany the Kid to VISA interview Mother or Grand parents would do ?

    3) Do we need to pre-send any documents or carrying the Divorce Letter stating Custody at the time of teh interview is sufficient?

    4) Any thing else to be kept in mind/any complication expected during the process?

    The kid does have a father's name in passport, hence it should be mentioned in the DS160 as well.

    Kids under 14 yrs of age really do not need to attend the interview - you can also use the dropbox facility. If at all interview is required, mom nee

    If the divorce decree says that the mom has full custody & father has no obligations whatsoever, then nothing is needed. Otherwise if the father has visitation rights, his consent is required for visa & for travel.

    VO will surely question about the custody, keep more documents ready & be prepared to answer.

      Thanks a lot for your response.Sorry for the other thread that was by mistake as the website - just showed O was logged of and did not confirm the posting.

        Then no need to fill in the DS160 as well. But be ready to answer any question VO may ask about the name of father in passport & DS160 - be truthful.

        To the best of my knowledge, there is no such legal rule.
