  • Visitor Visa for Brother-In-Law' daughter

My Friend is in USA on H1B visa and his Brother-In-Law is in India. His Mother-In-Law has Visitor visa. His Brother-In-Law attempted Visitor visa but it was denied.

They are thinking to apply for visitor visa for his Brother-In-Law' daughter so she can visit USA in summer vacation with his Mother-In-Law who already have visitor visa.

Could anyone of the experts, please help with below questions.

    1. Is it possible to have child appear for Visitor visa with grand-mother and not with her parents?

    2. If so, what kind of documents would be required from Child and from H1B candidate?

Kids below 14 yrs of age, can use dropbox facility to get their visa - no need for interview for them.

Kid will need consent from both parents that they are fine having kid travel abroad. Kid sponsored by parents is good enough, no need of any document from H1B.

Thank you Libra_14. This is very helpful however just to know the possibilities

My friend is traveling to India and would appear for Visa interview. Is it possible to have the neice child appear for an interview with him? Assuming her DS160 is filed and the child gets same interview slot as my Friend?

Yes, you can form a group while submitting/booking appointment & appear together for interview.

But your friend will be requesting H1 while niece will be requesting B2 - requirement for both visas are different & create confusion for VO.

        If I am at your friend's place, I won't risk my H1 for niece's B2.
