  • Visa Rejected 3 times at chennai -complicated

    Hello All,

I have a very complicated situation. I am totally confused. My mother was rejected tourist visa 3 times. The first time she applied was on May 10th 2005 she and my fayher planned to visit me and my husband. For the first time, both mine and my husband's papers were sent (Pay slips and Bank statement) My mother went through a harrassment the first time. The counsular asked her howcome your daughter is working where as she went on a Dependant visa. My mom told that we both got GC and I started working . My mother was then asked to give the finger prints.. my mom did not understand American axcent and English that well . She was asked to give the print of her index finger and she did not know which one. It seems the Lady yelled at her saying INDEX FINGER. My mom became very nervous from then on. She dint even ask for any documents.. she simply changed her mind and she said I am sorry you cannot be given a Visa. My mom became emotional and said that her daughter is pregnant and she needs the visa badly. For this, the lady said.. " In that case, you will never got to USA nor you will see your daughter there. She was told that she was a potential imigrant.

Second time, we applied in NOV 2005 in Kannada. Before this my Dad came to USA on a Bank conference and he was given 10 years visa. Second time we presented a promising letter that my father will bring her and take her back with him and presented all the proof documents and property documents that my father went back after his first visit soon after the conference. Also they mentioned that 2 of their sons are in India and they live with them. This is did not work..They said sorry and just gave a Potential Imigrant letter again.

We tried once again in march 2006 this year for third time but couldnt not get dates in Kannada so she went for english.. this time they asked her if she has any Grandchildren and she said NO. The consular said she is not convinced and rejected it again. Now i am pregnant again. so we booked a visa date again for nov 17th , coz my due date is dec 5th.

Please tell me what to do. Also I am looking for dates on the website with language preference.. It says No dates available. how can my mom explain to them .. she doesnt know english very well. God bless the soul who answers this query.

    Hi,

I can relate to what your family must be going thru, but I guess you can still hope to get the visa next time.
My parents went through the same thing and after been rejected 3 times, they finally got the Visa 4th time .They got for only one year , but we were more than happy with that.
We did the same mistake of not taking the appointment in Telugu when we first went for the Visa. They asked routine questions and rejected first time.Language was definetely a barrier as my parents do not speak english that well.(We were just over confident that parents would never get the Visa rejected).
Second and 3rd time, they attended the interview in telugu ,but after few questions the Counsulate Officer would ask why they were rejected the first time and when my parents replied they are not sure why they were rejected, they rejected them again.

My parents first attended for Visa in 2004 Apr and another 2 times in May 2004.So, they were rejected thrice in 2 months time.We gave a gap and finally decided to try again and luckily we got the visa this time.

For the 4th time, this is what we did different.I don't know if this made the difference, but it might be helpful for you.
My sister is married and she & my bro-in-law got their US citizenship last year.We were showing my bro-in-law as the sponsor all the time and included just his paper work.
This time , we showed my sister as a sponsor and then included the paper work of all the three of us.(Sister , bro-in-law and mine).
We included the citizenship docs , my h1b papers, pay rolls, bank statements and tax returns of all the 3 of us.
They attended the interview this jan and this time they asked the questions more about me.Where I work...about my previous job...etc and finally gave the Visa.(Although my sister is listed as sponsor , their questions were more about me.)

So, good luck to you and try again.Just give A LOT OF ATTENTION TO DETAIL when preparing the paper work.Feel free to ask if you have any questions.

How did they know about you? Did your mom mention it? Or did they check the papers?

        Hyennah,
based on your description I think you made the mistake of sending your parents the 2nd and 3rd time within 2 months of first rejection. Nothing changes in 2 months. Also did your parents have any children in India or all of you were in US the first time it was rejected?

My parents mentioned to them that I am in U.S.
My elder brother is in India.Me and my sister are in U.s
As for sending them for visa thrice in 2 months...we did that coz we thought that the interview in telugu might help in the second time.by the third time ,we were just desperate. My sister was expecting too and my parents wanted to be here.

Yes , I think thats exactly what we thought and booked it again in Kannada. This time we have 8 months of Gap. I hope it works. Both my brothers are in India , and last time my mom showed a letter from my brothers also.. stating my brothers live with her and they are well settled in India. The consular read everything but still rejected it. I am not sure if my husband itself should sponsor now.. coz I am not working. I am worried that dates for kannada or not available though.
