    Need help please.

    My mother has a valid US visa. She had 10 years visitors visa and listed 5 times (in 10 years) in the past with couple of approved visa extensions. Again she had renewal of her 10 years visa in 2017. visa. She came to visit us year and just left from USA to India in the first week of January 2019. We applied for her Extension of Stay (i539) in July 2018 and received a receipt number (EAC1890129802) dated in September 2018. We also received a second letter on December 2018 that for faster processing the application is being send to Texas Service Center. Till date, a decision for her extension application was not received from USCIS. While EOS application was pending, the purpose of extension and requested stay date was had arrived. She left USA to India to tend to family needs in India as per original plan and since tickets were booked since her extension. She got a call from consulate the next day of landing that that her visa has been cancelled. We asked /emailed the support team for reason why visa got cancelled and didn?t receive a reply back other than stating that of she needs to travel apply for a new visa. We dint know why her visa got cancelled. What if any further steps/options that we have. I am Indian born but now a US citizen. I am afraid that they might not approve her visa even if we apply again. But planning to wait for an year atlas before we apply. Applying green card or immigration is an option with out a visa currently. Please help.

    What was her visit pattern ? how long she stayed during each visit ?

      she was here 11 months X 2 in the previous 10 year visa (both times her extension got approved) and 9 months last year with new renewed 10 year visa ( last years extension results still pending) but she left on time as she requested on the visitors extension application.

        How long she stayed in India after returning.

        We can only guess about what could have happened. My thinking is its because of her long stays in USA & keep coming every year.

          Ok. Could be. she used to stay 6months-1.5 years in India before returning. What are our options for her future travel. I am afraid that if we apply for new visa, it might be denied for the exact reason. Can we apply for green card or immigration while she is out of country?

            Give it a try for another B2. If rejected then apply for her GC.

              When we called visa office.They did not give us a reason for cancellation and asked us to apply for a new visa. is there any point in hiring a lawyer and pursue why the old one got cancelled? Can a green card be applied with her visa being rejected? sorry I am I ignorant.

                One visa rejection doesn't have any impact on other visa applications - unless it is related to your profile.

                For example, an person with criminal background will surely be denied for other visa. But an visitor visa denied on the ground of not enough ties to home country won't have any impact on Green Card.

                Go ahead, try for her B2 once again (if you want) & if rejected apply for her GC.

                  Ok. Thank you for the reply.She is not planning to visit for the next 1.5 years. Is to better to wait and apply when she is planning to visit? Is it better to apply now as her visa got cancelled recently. Can I apply for green card and get it approved when she is in India (as she can not come here as her visa got cancelled)?

                    Better to apply for tourist visa just before your intended travel.

                    Yes, you can do so - its called consular processing. GC has a different section within this forum & you can get experts for GC there.
