COS from B2 to F2: Do you need to file a gap I-539 like with COS to F1??
When doing COS to F1 you need to file a gap I-539 per the "Your current status will expire more than 30 days before the initial F-1 or M-1 program start date" USCIS guidance. How does this apply for COS to F2? If B2 expires in a month and spouse is in valid F1 status, do I, as a B2 need to file a gap I-539 while COS to F2 is pending? (the same as I would if I was doing COS to F1)? Can I file such a gap I-539 to extend B2 as a back if the COS to F2 gets denied? Thanks!
