    Hey all,

    I am new to here, but I have a specific question about my situation with my mother. It is my first time posting here, please do bare with me on this.

    My mother has a Canada passport and visited US between Sept 4, 2018 and return to Canada on Feb 20, 2019. (less than 6-months period). She came here to visit my newborn baby.

    She then is still interested in coming to US, but is afraid of the exceeding the 6-months period of her tourist status (Canadian don't require visa to visit US).

    So here is my question:
    If she books a ticket now and wants to come over on April 2019, how long can she stay? Can she still come over now on April before we just stayed more than 5-months here.

    Since Canadians doesn't need visa to travel to USA that 6 month tourist rule doesn't apply for her. Can she certainly re-enter into USA now & stay again for the duration of her I94.

      I found this online, so I wasn't sure what is the border law on this. Can someone please advise?

If you stay for 6 months, you must depart the United States for 6 months before you are permitted to re-enter as a visitor. You cannot stay for 6 months, leave briefly and re-enter for another 6 months.

      Canadians can visit the U.S. for up to six months in a 12-month period. Visitors are admitted in B-2 status and business visitors enter in B-1 status.

The officer may believe that you have abandoned Canada and you really are living permanently in the United States and the officer has the authority to refuse your entry on that basis, because they don?t believe you are a temporary visitor anymore, in fact you are really permanently living in the United States. But technically if you show that you have ties to Canada, that you are visiting the United States and you?re spending a lot of time there but yet you are still a genuine visitor, you can stay longer than six months in total in a given year.         Is this an authentic site?

        Its clearly mentions that if you do it repeatedly several times, like keep re-entering USA again & again - its misusing the visa. Once or twice is fine.

          This is wrong. There is no such rule, for visitors from Canada or anywhere else. You can always stay for as long as you are admitted, and they can admit you for 6 months each time, regardless of how recent your previous stay was. Or they can admit you for a lesser time or deny you entry altogether.

          Some people talk about 6 months in the context of passing the Substantial Presence Test which would make you a resident for US tax purposes, which some people want to avoid. But that does not have anything to with how long you can stay for immigration purposes.
