  • Parents Visa got rejected the 3rd Time. How to get reason

    Hi,

My parents visa got rejected for the third time at the mumbai consulate.

    1st rejection - 2001.
This rejection was totally understandable because they had applied for a family visitores visa along with my brother who is young.

    2nd rejection - 2002
    3rd rejection yesterday June 27th 2006

    The following questions were asked

VO: Is your son a Green card holder?
    Dad: yes.

VO: How did he get his GC and can you show me a copy of his GC
Dad gave him the copy but didnt answer the question as he wasnt sure how I got it. (I actually got it through my wife)

VO: Show me your sons passport
Dad gave him a copy of my current passport. I have an expired passport which has my expired H1 visas. Dad didnt give the copy of the old passport to the VO.

VO: Do you know why you were rejected the last time?
    Dad: I dont know

VO: What do you do in India?
Dad: I have a xxxx export business and dad was about to give him the papers for it and he said no need and rejecte dthe visa.

I am extremely disaapointed by the whole thing. My Dad is 63 yrs of age and mom 56.They will never settle in US and just want to visit me but cannot. They also have an unmarried son in India and also have a house worth over 1 crore but the VO didnt ask for any of that information.

Is there any way I can find the reason of the rejection and should they take the next available appointment for an interview again.

    Please suggest.

    Thanks
    Randhir

Sorry to hear this. I think you should contact your local senator, explain the facts. The senator's office can request the consulate to reconsider their decision.

check the last page (?) of their passport. There should be something written or stamped there stating the reason?

Infact I even had a reference letter from the local congressman sent to the US consulate but they still rejected it.

Regarding whats written on the last page i'll only know when my parents get back home from Bombay.

rcmax, Can the decisions be reconnsidered. By local senator do you mean congressman or the state senator. Please suggest.

Contact your state senator's office, not the congressman.

Yes, the senator can request the consulate to reconsider but thats not a guarantee that your parents will get it. However you should be able to get more answers because the consulate reply to the senator's office will be available to you.

Should I send an email to the senator or should I send a letter. Usually there are 2 senators per state. Should i contact both or just one.

Is there a format out there which i can follow for this.

go to that website, select your state senator who has office closer to your town and open the senator's website. You should get all details in his website. Each has his procedure.

Thank you rcmax. I will definitly do that.

If its not too much to ask , Do you have a format that I can use to draft a letter. I am so unhappy today that I cant work or think properly. I had so high hopes this time that my parents will get a visa to come and see how their son is living in US.

Thanks a lot rcmax. Have the decisions been reconsidered in the past.?

Thanks a lot for your help.

I don't know whether they were reconsidered, no way of knowing it. All I know is senator can request the consulate to reconsider thats the best one can do in this situation. If nothing, you will know the exact reason behind that generic 214(b) rejection.

                          Senator's letter

                          Dear Randhir & rcmax,

If it's not too much trouble, can you please email me the draft for the letter to the consulate. I've been going thru a situation myself where the visa status on the chennai conuslte's website indicates as "pending process", and i was thinking i should probably contact the senator as well.

Would you please so kind to email me the doc at [email protected] ?

                          thank you...

                            Dear Randhir & rcmax,

I am in a similar situation. My parents were rejected twice and I posted on this board for advice. rcmax has been kind enough to give some pointers. However, I did write to my local Senator. He requested a reconsideration from the consulate. The consulate replied back to the Senator that they were rejected under 214(b) becuase they were unable to show social/family/economic ties back home. That they weren't given a chance to explain or show any supporting info is beyond the point. It also stated that they can apply again..blah blah. The Senator's office forwarded me the reply. So, the Senator's efforts didn't help either. Anyways, doesn't hurt to try. Good luck and keep us posted.

Same situation - please help me with the letter

                              Hi Randhir & Rcmax,

I am another person who is in the same boat. My in-laws went for tourist visa in Feb 2006 and they got rejected under 214.B This week, my Mother-in-law went for the interview alone but stilll got rejected agian under 214B without proper explanation. This time we tried our best to prove her economic/social/family ties (husband staying back in india, another daughter lives and owrks in india and mother lives iin India) but it was useless. My wife wants to write a letter to the senator to seek his help on this. Could you please take the pain to email me the format of the letter sent to the senator?

It is so frustrating right now!

                              Thanks,
                              Srini
