Visitor Visa (B2) denied with 214b. Need help on next steps

    Hello,

    Need your advise.

    My mother-in-law attended B2 visa interview today at Hyd consulate and it was denied with 214b.

    VO asked for applicant (i.e mother-in-law's) passport and copy of my wife's passport (handed over to the officer)

    Interview:
    VO: Is you daughter in US?
    MIL: Yes

    VO: is she married?
    MIL: Yes. She is married

    VO: does she have children?
    MIL: Yes, 1 son. 8 years old

    VO: where does your daughter work?
    MIL: She works as a Freelancer from home. (also added son-law- works in ***IT company)

    VO: is their house own or rental?
    MIL: They stay in rental apartment

    VO: Do you have relatives in the US?
    MIL: Daughter, Son-law, grandson. Other than these I do not have anyone in the US.

    VO: Sorry mam, we cannot issue visa at this time.

    Question
    What could have gone wrong?
    What needs to be addressed while re-applying for next time?

    Please advise.

    You are the best one to identify what could have gone wrong. Following questions can help:
    1. Why was she applying along? Why not along with your father-in-law?
    2. Is your wife working as freelancer on a legitimate visa?
    3. Does she have any other child back in her home country?
    4. Any property/income she owns - or is she dependent on you?

    You can re-apply if her situation is changing, otherwise the result would be mostly the same.

      Hello, Thanks for your reply. Below are my responses for the queries.

      1. Why was she applying along? Why not along with your father-in-law?
      My mother-on-law is a widow (father-in-law passed couple of years back)

      2. Is your wife working as freelancer on a legitimate visa?
      Yes. She holds valid EAD valid until 2021.

      3. Does she have any other child back in her home country?
      Yes, 2 daughters are in India. Both are married.

      4. Any property/income she owns - or is she dependent on you?
      She has own home/property in India. She is not dependent on me.


      I was sponsoring for the trip. Not sure why the visa officer asked my wife's (applicant daughter's) passport copy.

      Do you think we should re-apply as 'Self Sponsor'? Please advise.

        So, I see two possible reason here:

        1. Being a widow, she is indirectly dependent on her children.
        2. If she has property & a regular income (like pension) - let her sponsor her own visit. Self sponsoring tourist visa is always better, as it shows that the person is capable to take care of herself financially.
