Pending I-797

If you want to travel back to US while your application is still pending would you be traveling on your pending visa or on a VWV?
I have asked for 6 extra weeks on my B2 visa and left on the day promptly. However my application is still pending on their website. If I wanted to go back for a week would I be allowed back without any problems? I want to fly back to a wedding.(not mine) I have been told that if you ask for 6 weeks you get 6 weeks. If that's so I would fly back on a VW, right?

I hope I understand your question................Are you saying that you applied for an extension of your stay on your B-Visa?..........if so, that application ended when you left. Once the application is received by USCIS, you remained in status and could have stayed until you got a deciison, even if it was a denial. Once you leave however, that application is no longer valid and you cannot reenter on that extension but would have to reeenter with your B-Visa if its still valid, or on VW if that option is available to you.

i understand. i just wanted to make sure that a pending I-797 would not jepardise my return. so if i said i was leaving on such and such a date they would assume i left on such and such a date. or how would they know i have already left? if i get a denial (no particular reason for it) for the extra 6 weeks but i have already left how would that affect my future travels? kinda scary to even think about it.

They would know when you left based on you giving back I-94 form at the airport while going back.

As long as you left before denial, you are fine.

....Also to quiet your fears, just keep a copy of your ticket/boarding pass
