  • Query regarding sponsorship - Plz help..

    We recently moved to the states and would like my mother to visit us. Her appointment will be sometime in Feb/March 07 by which time my husband would have worked here for 7-8months on H1b visa and his visa is valid for another 3yrs. I am not currently working. My sister who is a greencard holder sponsered my mother in July 06 and the visa was denied under 214b. My mother had visited my sister previously and stayed for 1year (after visa extension). So this time they asked why she stayed for 1year last time and my mother couldnot answer properly because of language difficulties. Visa was denied.
    I would like her to reapply and prefer my husband(son-in-law) to sponsor this time b'coz my sister may or maynot be working for the next couple of months, my brother-in-law is working but he also will be another son-in-law like my husband and also I feel that we might be able to say that the circumstances have changed in that we have moved to the USA, my mother would like to visit me and that's why we are reapplying. My questions are;
    1) Because we have been here for less than a year, and son-in-law is sponsoring while another daughter had previously sponsored, does that make any difference to the visa officer's decision making? My husband is a doctor and works as a fellow.
    2) With two daughters staying here , one on greencard & the other on H4 and son-in-law sponsoring, would that be seen in a negative light? My brother, another sister and father live in India and my mother absolutely has no intentions of staying here for long time.

    I am in a bit of dilemma regarding the sponsorship. Any advice gratefully received........

    This time again , the interview may focus on her past stay of one year ,
    which was a mistake on your mom's part. When you stay that long on a
    visitor visa, the consulars tend to think you like it there and may in future
    want to settle down in US. This time, prepare your mom with a valid reason
    as to why she stayed one year and for this time, she should be able to show some compelling engagement in India that will necessitate her return in 4-5 months.

    I'd also suggest that if she is financially very sound, she should show self-financing of the trip and not depend on a sponsorship from you people.
    That goes in favour of the applicant as the consulars think that financially
    independent people are more likely to return. One of you can simply send
    an invitation letter and copies of your passport and visa status.

    If that is not possible, it is better that the son-in-law who has been
    in US longer and with better income sponsors.
