    Hi ,

    My friend wants to go on a visiting visa to US in the month of April 2007and then later change for H1B, meanwhile she is planning to work there on Visitors Visa , one of her seniors said that :
    ''
    colleague has said that after the department of labor(DoL) clearence from where it is then forwarded to the USCIS for H1B processing, which is the one which takes the longest time , one can work even on visit visa.

    labor clearence is said to be cleared within 2-3 weeks and is obtained by the employer undertaking that he shall pay the candidate equally with the US citizens ''

    How far it is true? Kindly, let us know.

    Law forbids paid employment on a visitor visa. I advise against it.
    If detected, you will be considered as having violated the norms of your visa
    ,your visa will get cancelled and you will be in big trouble.

    I suggest you wait till your I 94 card comes back with an H 1b stamp.

      Let me dive in with my opinion.

      If a person is already on H1 visa with employer #1 and is moving to a different job to a new employer, he can start working with the new employer right after they apply for the visa without waiting for its approval. If he has the receipt stating that he applied for the H1 with the new employer, he is eligible to start working with them. But, when a fresh H1 is being applied and when the person is on a tourist visa, I don't think he can start working without H1B approval.
