    My mom has come for a visit on Visitors Visa for 6 months. She has a 10 year visa. She can stay in US only for 6 months. Her stay expires on December 21st 2006.

    Can she go back to India on Dec 21st, 2006 and come back to US in January 2007 ? Because 2007 is a different year than 2006.

    My question is - The 6 months time that the visitors are stipulated stay in US - is it tied to a calendar year ? If so, One can stay in US from August to December and come back immediately next year in January. If not, then there has to be some time gap between each visit. What is that time gap if that gap falls within a calendar year and if it falls in 2 different calendar years ?

    Whether the gap falls in a calendar year or not does not matter! Frequent visits might trigger questions regarding her intentions to enter US and might call for a cancellation of her VISA. Recommended gap between visits is 6 months. So if he is leaving in Dec, she can come back in June of 07 and that should be fine. Search in this forum, there are many many people who asked the same question and were given an answer.
