  • Visitor visa rejected-Need some suggestions

    Hello Friends,

My mother went for her Visitor Visa interview on 10th October,2006 and they rejected it. My mother is a Retired Doctor, Widow. She lives with my sister’s family in India and I am the only son living in US. I sent her all the documents (100% to the best of my knowledge). But at the entry point (in chennai consulate) itself they only took her DS-156 & DS-157, her Passport and the HDFC receipt in a folder and ask her to go for the personal appearance.

Only 4 basic questions were asked:

    1. When did you retire?
    2. How long your son is in US?
    3. Where is he working?
    4. In India with whom are you staying?

She gave the correct answers. The VO told ‘Sorry Madam we cannot issue the Visa for you this time. You may apply some time later’. He never asked for any other information or supportive documentations. My mom asked is there any specific reason for rejection and he just told a ‘Sorry’. It is really amazing that why no other documentations or questions were asked for !!

Potential reasons for rejection I guess are:

    1. As I am the only son, they thought she (because a Widow) may settle with me in the US (She had all evidence docs for her strong family ties in India like property docs etc)
    2. Is it due to the reason she is a Doctor?

Anyhow, we are planning for a second attempt shortly. Before taking the appointment, I thought of getting your valuable suggestions (from your / friends’ experiences) on the following questions:

Ø Is there any time frame / restrictions between two consequent visa appointments?

Ø As she is a Doctor, I took the appointment in English last time. She did not had any issues in understanding / responding to the questions. Should I try this second attempt in Regional language or go ahead with English?

Ø In the DS-156, we just mentioned the status as ‘Retired’ and we didn’t mention that she is doing her private practice etc. Shall we mention it in the DS-156 this time? My fear is the VO may ask how we missed this data last time?

Ø As the guidelines states that it is Mandatory for Male or Female of any age to fill in the DS-157, we did it last time. But some friends are saying it is not necessary. Any suggestions on this please?

Ø My current visa stamping ends on Feb-2007 and I am applying for my I-94 extn as still I can stay for 2 more years. Will this be a problem if I take her appointment next year in Feb or March? What supportive docs might be required?

Would greatly appreciate any suggestions from you friends.

    Thanks,

    MM.

My mother-in-law's visa was rejected first time. She is still employed as a Govt teacher. She is a widow. She felt her visa got rejected because she is a widow. That's how she felt.

Anyhow, we are planning for a second attempt shortly. Before taking the appointment, I thought of getting your valuable suggestions (from your / friends’ experiences) on the following questions:

There is no time frame/restrictions imposed by VFS or US Consulate. My mother-in-law went back within a month and she got the visa.

Ø As she is a Doctor, I took the appointment in English last time. She did not had any issues in understanding / responding to the questions. Should I try this second attempt in Regional language or go ahead with English?
If she is comfortable, you can take an appointment in English. It might be tough to get an appointment in other languages soon.

I don't have any specific suggestion on this. I think you should have filled it correctly the first time around. My advise is not to change it now.

Ø As the guidelines states that it is Mandatory for Male or Female of any age to fill in the DS-157, we did it last time. But some friends are saying it is not necessary. Any suggestions on this please?
DS-157 is no longer needed if your mom is above 55.
