  • Visitor Visa Question

My cousin would like to apply for a visit visa. His mother lives in the US and is a greencard holder. His mother did put in the paperwork for him to be able to eventually immigrate to the US. Meanwhile, his dad lives back home and is unable to travel due to permanent medical reasons. My cousin has been at the same company for 20+ years and has some land and small cash assets.

His employer will give him 1-month leave and will write a strong letter of recommendation.

Is there anything he can do to improve his chances ... or any tips on how he could prepare for this?

BTW, this web site is very insiteful. Thank you!

I am sorry to say, there is no point wasting his time and money, he will be
    denied 100%.

The reason; An immigrant petition already filed for him by his mother.
There is a question on form DS 156 for visitor visa, which asks,
HAS AN IMMIGRANT PETITION BEEN FILED ON YOUR BEHALF?
He will have to answer yes here. Which directly means he has immigrant intent.
Sec 214 b says that anyone with an immigrant intent will not be granted
a visitor visa. He will be denied under sec 214b.

The only visas he can apply for with a pending immigrant petition are H-1b
or L-1. sec 214b does not apply to them.
