    Hi, I have a good news and a genuine concern.

    I am a doctor from India. I had an interview with a hosp in philly and they hinted that they were interested in giving me the position. That's the good news.

    1. If they do give me a H1B, how long will I have to be here 'in person' after signing the contract ?

    2. Somehow, my gut feeling says, I should stay back till I get the I-797. Also there is another reason I want to extend my stay. The airlines have exorbitant rates to post pone my date. They are charging me $1000! But, my visitor visa is expiring in 15 days and I have not filed an extension yet. Is it fine to book for a visitor visa extension 15 days before the expiry?

    3. Should i be sending the original I-94? The USCIS says Yes. And many people I asked said No. The problem with sending my I-94 is that I cannot leave the Us without it. I do not want to stay for 3-4 months till they approve/deny. The max I will stay in US is mid-January.

    4. If I leave before they reply and then the denial comes accross, will that hinder the H1 issuance?

    The BASELINE ISSUE is that I do not want to be messing up anything after having given a H1B after so much of hardwork.

    It would really be very helpful if any of you did answer my query and give your valuable opinion to these concerns of mine.

    It takes a while for an H-1b petition to be approved (couple of months I guess) unless they file premium which costs more but takes 15 days.
    I suggest you call the CO-ORDINATOR of your residency program and find out if they are filing H-1b, regular or premium, and if they will send an I-797 to India. All programs will do that and you do not need to stick around.

    ANYWAY, If you leave before the ext response(even if it is a denial), there are no problems and H-1b issuance will not be affected but why get into this sloppy extension process, when you do not have to. Plenty of people, IT people and people who are interviewed over the phone get their I-797 in India , so you shouldn't worry about it.

      Correct me if I am wrong...
      Even though the flight may cost me a whooping $1000, I should not be risking the H1B by filing a B1 extension, which may cause a H1B issuance delay.
