Greetings friends! my name is Will V. and i have a brazilian friend who like to get on the path to becoming permanent here in the USA. she is getting her degree in biology first part of 07 and once she has that, she will be coming to the US on a visitor visa. mind you she has been here b4 on a work program from 12-05 til 4/06. well heres the question, how can she change her status to become a student and/or work without having to go back to brazil? im not ready for the fiance visa although i really like her, im not ready to commit to something that serious as were both 22 and im still in school and work as well. she really wants to stay without having to go back and were very confused on how to go about this, any help please?? sorry for the mini story i just wanted to get some info out there. i will be posting in this forum for the duration. once again, any help would really be appreciated because we are both very lost and scared and dont know how to go about this.

There are several ways, but first of all, does she have a visitor visa?
If she does not, on what basis will she apply? Let me advise you that it will be very hard to get a visitor visa for a young, single person especially when she is finished with her school in brazil, even if she has been to US before
on a school program.
Please answer, then I can advise you;
1.Are you a US citizen?
2. Does she have a visitor visa? If yes, what is the validity?
3. Will she get her bachelor's degree in 07 or is it a smaller degree?
4. What are her future plans in US,career wise? Does she want to study
further or work?

Thanks for the reply my friend! =) to answer ur questions; 1. Yes im a US citizen, born and raised 2. Yes she has a visitor visa valid til 2009 3. shes getting her bachelors in biology 4. she first wants to work and once shes financially stable she wants to continue her education ASAP to get her masters in biology, but she does want to go back to school as soon as she can, while working even if its only a little. i hope these answers help with the questions you asked, once again thanks for your help!!

Ok . It is great that she has the visitor visa.
Advice;
*When she enters US on her visitor visa, it is most important that she does not mention her intent to work or study when they ask her the purpose of visit. These are not allowed on a visitor visa and they will send her back if she mentions that. She should just say she is here to visit her friends and for vacation for 4-5 months. Hopefully, they will stamp her stay for 6 months.
*Assuming that she got a stay of 6 months, the next step is to look for
an employer who will file for her H-1 visa. She is eligible for an H-1 because she has a bachelor's degree. You will have to look hard because there may be many jobs in biology but not all will be willing to sponsor.
One option is to start volunteering(without pay) in a biology lab in a
good institution and at the same time look for any openings there. If they like her volunteering work, they may even be willing to sponsor her for an H-1 visa for any entry level opening they might have. If her H-1 is approved,
she can change status B-1/B-2 to H-1 while in US.
*She should keep looking for low cost biology courses in US too.That is if
the employer thing does not work out, she can enrol in a student program and change to student visa.
