  • Sponser Question

Visa was rejected for my parents twice and they have an interview in January. They are going after one year gap. There visa was rejected under 214b. I have sponsered them the last two times. Should my parents sponser themselves this time or should my husband sponser them instead of me? If the my parents should sponser themselves then should we still send the sponser papers? What do my parents need to show if they want to sponser themselves? How much bank balance should they show?

My dad has retired two years ago, but he has just started a business with partners and it is only 3 months old. What should I put in the application - Retired or buiness? There are no IT returns for the business as it is only 3 months old. He can show the partnership deed and bank statements of the business. Will the visa officer think that they are showing business to just prove ties to India or will they think that it is genuine. My parents also visited Europe last year for 15 days hoping that it will be a plus point for the visitors visa to USA.

    Please advise
    Thanks

    Hi

My parents who were approved by the Chennai embassy recently for visitor visa showed net property around 45 lakhs including house worth 25 lakhs.

Ensure that the invitation letter you send has a short duration. less than or equal to 3 months. If possible carry a printout of a blocked itinerary.

Also mention any social/cultural activities parents are iinvolved in to show strong ties to India. Membership with any associations, committess etc does help.

    My two cents
Wishing you the best of luck. These visa procedures are really taxing.

People spending their own money is a factor in their favour; it shows that they are financially independent and so the officers tend to think of them less likely to stay back in US. In your dad's case he'll have to show that he is spending money out of his savings and retirement money. The best way is to have all assets (immovable and liquid) listed on a CA's letter head and the CA should attest it with a total net worth showing a big figure in bold at the bottom so the officer can look at it
at one glance. In this case you only need to send an invitation letter .
(NO financial papers and NO I-134 required). Also send a copy of your passport and visa and your birth certificate showing your parents' names.

About your dad's business , it does not matter if it is 3 months old.
He must show it because it will act as a great tie for him.
He must get it registered with the govt.

          For more advice you must post the details of the last 2 interviews;
why they were denied? Do they have any children in India?
How many in US on what visas? Is your mother working?

            why they were denied?
214b, do have sufficient ties to India. They went to the interview with a month's gap.
Do they have any children in India?
Yes, 1 daughter married and she has two kids

How many in US on what visas?
            2
            Myself - Green Card
            My brother - H1B

            Is your mother working?
            No. She is a housewife

They have property over 75 lakhs in assets and investments. Not much in the bank (liquid cash). How much should they show in the bank?

Thanks a bunch for your help. greatly appreciate it.

Ok. The main reason for denial in their case is ---no single children in India
and two in US(one has GC). THis is a big issue and here there is high level of presumption of immigrant intent and chance of denial even on the Jan interview. Even if you change two factors ---self financing and showing your dad's business, which is only 3 months old, the presumption of immigrant intent cannot be overridden because of the children issue.

So, a change in strategy is warranted.

Is it possible for you to cancel the jan appointment?

Get another appointment and let your mother apply and travel first.
              Your father would act as a tie and when asked why he did not apply;
your mother should say he has just started his business and show all the business documents. That will add credibility to the whole situation
and will offset any presumption by the officer that your parents may have any immigrant intent.

Your dad can apply later when your mother has travelled once and that way
he will be several months into his business, which will be a positive factor.

It is good that they have 75 lacs worth of investments.
Your mom should show above 5 lacs in savings a/c, and rest in other investments (FDs, bonds , whatever they have).
If they plan to boost up the savings a/c by transferring money, do it gradually over some months.
One common question asked of parents is if their children send them any money; the answer has to be no.
And they should not show any savings a/c with US $ remittances.

                Hi

In response to your earlier question, I sponsored my parents myself as i am working here on H1B status.

Since i am the only daughter of my parents and my dad is retired, they had a pretty long interview (40+mins) and had to really convince the officer that they will not stay back after the agreed period.

Three factors that worked in their favour (i think)
                1) My parents look after my grandmother 6 months/year
                2) They had not applied for a visitor visa so long ( i have been in the US for 6 years)
                3) My parents just completed construction of their new retirement house three months ago.

The best strategy in my opinion is to tell the truth. We don;t have to volunteer extra information, but if they ask a specific question, tell the truth.

Apparently, some couple who said they have other children in India (They were lying) were asked for the children's phone number, they got tense and were rejected rightaway.

                Wishing you the best
                Sitara
