  • Mom's Visa....Need help

    Hello, let me thank you for doing a great job.....
    here is my situation and i am confused about what to do.....I am in US for almost 8 years and i am a GC holder....unfortunately i did not process a visa for my mom who is a widow and have no other kids than me for all these years.....recently i have applied for her visa and she attended an interview at Chennai consulate in the month of September. The visa got rejected saying that i am only child and she has no ties with India to return back and i am a GC holder so she could be a potential immigrant. Now i am thinking of process her papers again and thinking of sending her to Calcutta to the visa stamping as my cousin lives there.....can anybody suggest me on what to do to get her here.....can i give a written letter promising to the VO that she will return back as my mom's brother is dependent on her and she has to go to take care of him? Your suggestion is very valuable to me.....

    such letters have no value....after all, how can such a promise be enforced? Answer: it cannot. As to this new amazing story about a cousin that suddenly needs care, well, if your mother can leave this cousin for months, why not years?

      If you read this forum , there are countless postings
      about widows with no children in INdia having a very hard time getting a visitor visa.
      How long for you to become a US citizen? You can get her to US on an immigrant visa within a year after you become a citizen. That is the surest way.

      IF you still want to try for her visitor visa; please describe in detail about *her brother's situation ; what he does, how he is dependent on her when he is in calcutta and she is in chennai.
      *ALso, what is your mother's education and has she worked or is she working?
      *What is her financial status?

        your mother can not take an interview in Calcutta as she needs to prove that she is living in the western parts of India for the last 6 months; as she took her interview in Chennai consulate in september, its not possible for her to take an interview in Calcutta as of now.
        Best thing before she take up her 2nd interview is to take up an employment here or get properties in her name to show that she has enough ties in India or she can show she has elder people in India who are dependant on her for whom she has to come back.

          Rathi is right ! The appt page clearly says, if you are reapplying you should apply in the same consulate. Even if you go ahead and apply, you will be sent to apply again in the same consulate you applied first time.

            Thank you guys for all the information...well my mom is not educated and can speek no ther language than telugu. she is 60+ years old, i still have 2 more years to apply for my citizen ship. what more can be done on resending her for the visa?

              I suggest you wait 6-7 months and during that period help her develop some occupational ties to India. Even if she is uneducated, she can still run some small business, or a telugu tuition center or a small sewing center, or can attach herself in some postiton to the local temple; you can think of more ideas on these lines, according to her situation which you know best.What ever she does, she should have it documented on paper like registration of small business with govt. etc.

              Once she has worked in that capacity for some months, she can apply
              for a short visit with you as a sponsor.
              THis is the best that is possible.

              If this does not work, she has to wait 3-4 years from now, when she can get an immigrant visa based on your citizenship.(2 years for you to apply for citizenship + 6m-1yr to get your citizenship + 6m-1yr for her immigrant visa processing)

                Mom's VISA from Chennai

                1. DO NOT re-apply from anywhere else.
                2. You should have already sent your letter to AMCON about your invitation and another to your mom inviting her, as a part of the process of the B1/B2 visa.
                3. Contact your local senator's office and request them to help you out. They're usually pretty good at this and have the ability to send instructions to the US Consulate in Chennai to grant the VISA.
                Make sure you remain absolutely truthful and do not lie for any reason whatsoever. At the same time, give them justifiable reasons of why you need your mother to visit you, like she needs to see her grandchild etc.

                I'm surprised at the same time, unless I missed something, how come you never invited your mother for the past 8 years???!!!

                  my advice is not to get any such letters from the senators, as the VOs consider such letters as interference with their work. Moreover, such letters doesnot guarantee anyone a visa.
                  If you really feel your mother's case needs more help, perhaps you should ask your mother to consult an immigration attorney, who might give case sensitive advice to your mother.
