    Hi All,

    I need an advice, I would like to know if it would be good to apply for a visitor within a span of 1 month if the visa is rejected.

    FYI
    They have put a 214(b) reason for the rejection.


    My parents visa was rejected on dec 28th and I am thinking of re booking a slot for my parents again I see there are dates available in february is it a good idea to book it right away or is it a good idea to wait for 6 months and re apply again.

    Please advice me, I would be greatful to any advice.

    You can try again at any time. But unless you have substantial change of circumstances, it is unlikely to be approved again.

      Immihelp is right. Please provide the interview questions and answers that your parents gave, for further advice.
      Also state your visa status in US, did you send an I-134, what your parents do in India and do they have any children living with them?

        Thanks for your replys.

        These are the following questions they asked my parents

        1) how many children do you have
        ans) 2
        2) where are they
        ans) both are in US
        3) they asked do you have any more children in usa
        ans) they told they donot have any children but my dads mother and their family are in INDIA and also told about and also told about mothers family.
        4)is ur daughter educated if so what did she do here
        ans) yes she is did her MCA
        5)what does ur son do
        ans) he is a software engineer
        6) when did he go to us
        ans) august 2001
        7) for what
        ans) doing his Masters
        8) what does your son-in-law do
        ans) he is also working
        9) they asked my father what do you do?
        ans)he told he does farming and he has taken VRS from *** company
        10) did you work anywhere
        ans) yes i worked for **** * company

        she did not see even a single document of sponsorship nor my parents she had only the ds-156 and ds-157 of my parents and she told that we cannot issue you visa due to the us laws.


        Yes I did send all the documents required along with I-134.

        would there be any chance if I ask my parents to attend the visa separately.

        what would be nice bet for my parents to get visa.

        I would really appreciate any help.

        There was a muslim lady there was no translator it was in TELUGU.

          The main reason for the denial was;
          all children in US and your dad has taken VRS so there is high likelihood that
          he won't come back to India.

          The embassy requires everyone travelling together to apply together so applying separately will only work if one (mother) applies and travels alone.
          That way the chances of her getting visa are better because dad will act as a tie. He can apply after she has made one trip.

          Another tip is not to send I-134 if your mom can show strong finances in India and can say that she will spend her own money for the trip.

          Also, she should wait a few months before applying.

            Thanks peace, for you reply.

            My mother has enough financial support to pay for her trip. My dad told that he has taken VRS like 3yrs before and I did not know it would count but I would like to know how many months would be good before I take a
            re-appointment for my mother.

            I really dont know what would be the good time duration for the next appointment could be please let me know what would be best time to re-apply again.

              Wait about 6 months. Reapplying too quickly shows desperation.
              Let your mother ask for a short stay like 3 months.
              She will be asked;
              *why is your husband not applying this time?
              A. He is too busy with his work at this time.
              *Why only 3 months?
              I do not want to leave my husband alone for too long.
              *How come your son sent an affidavit of support last time and now you are showing self-financing?
              A.We thought I-134 was mandatory but a friend told me it is not. Why should I depend on my child for a trip when I have enough money.
              *Does your child send you any money?
              A. NO

                these answers will be in direct contrast to the last set of answers....last time they asked for 6 months, now, by an amazing coincidence, only 3. Do you really believe that the VOs have not seen and heard this 'strategem' before? Why would they believe it?
                Also, it is specifically forbidden to point to a relative that is staying behind (again, another amazing coincidence) as a tie to one's country - in fact, that will usually result in an instant denial.
                Trying to change stories and find the '***** one' generally reinforces the initial decision....that there is more to the story than is being revealed.
