  • B2 VISA rejected.

    hello,
    my inlaws were rejected visitor visa. they were given 214 b, showing that they dont have enough ties in india... they have their younger son in studying in india and showed decent bank balance and notarised affidavits as said in immihelp....but the visa was rejected . VO didnt ask much questions
    just.. who is in US?
    how soon can they attend another interview?? what changes should we make in the documents? is there a greater chance of getting visa if MIL alone attend the interview showing that FIL is in India... does that make a good tie in india so as to convince the VO that she will return???
    Immihelp please help..

    Need more info;
    *Can't be just one question. Please ask them to recall IN ORDER what other questions were asked and what they answered ; even if they were minor questions.
    * What all documents did the officer look at?
    * What is your visa status in US? How long have you been in US?
    * Do you have any siblings in US? On what visas?
    * Did you send an affidavit of support; I-134?
    * What do your parents do in India?
    * What is their financial status in India?

        Sorry , missed your post.
        Actually, young , single children in their 20s are not considered to very good ties because the officers think they are independent.
        ALso, the retiree status of your FIL is a negative factor.

        Yes, she should apply alone after a few months. Preferably in summer,
        say in April. Let her show that she is spending her own money. She should present her financial status in a proper way, like a statement of assets prepared by a CA and accompanying statements. Her daughter should only send an invitation letter,
        and her passport , visa copies. You should not send any I-134.
        SHe will be asked why her husband is not applyig this time and she should say he is busy with his work/ dejected by first denial and does not want to go. When asked how long she wants to spend in US; she should say
        about 2 months. Why so short a period? "I need to come back and look after my husband and young son."
        It is also better if she shows that her husband has some occupational tie;
        self-employed or attached to an organization.

              What I mean to say is nobody should sponsor. Sponsorship means sending
              an affidavit of support(I_134) and if the applicant can show (as you said she has healthy financial status) that she has enough money for the trip ,
              there is no need for an I_134. In this case, all your wife needs to do is send a letter of invitation (addressed to the consular,
              US embassy, describing her visa status in US and requesting the officer to grant her mom a visa to visit her for 2-3 months
              and mentioning that she will be spending her own money for the trip). Also she should send copies of her visa and passport
              and her bc with her mom's name on it.

              But you must make sure she/her husband do have very good financial status.
              If there is a doubt , you send an I_134.

                  It does not matter if everything is in husband's name. A husband is supposed to spend for his wife.
                  Please tell me roughly ;
                  #the annual income he has , if any, from any source, and how much he shows in his tax returns;
                  #savings a/c balance (will have to show last 6 months statements)
                  #deposits (FDs, bonds )
                  #shares and mutual funds
                  #life insurance policies
                  #property value
                  #any other documented investment
                  Then I can advise you if it is better to sponsor or to show self-sponsoring.

                      The reason was insufficient ties to home country most probably. You can reapply but for someone of her age and without any major change in circumstances, it would be futile.

                        my parents visa got rejected yesterday .. my father is retired n me n my brother are outside india .. my brother is just on a project for few months in UK .. he asked if u have any other child in india .. they said No ..
                        we think this might be the reason ..

                        but the thing is they were not given any rejection form neither was any stamp in thr passport for denied or rejected ..
                        what does this mean .. shud we reapply or wait ..

                        we were sponsoring thr trip this time .. so they had all the docs also ..
