  • Can somebody help me please

    After completing 3 years of education (Masters in Information
    Technology) in Sydney, Australia I came to US in May 2002 on a H1B visa. After
    about a year or a lil more I transferred my H1B visa to a different
    company. I officially got married in June 2004
    and since my wife is a citizen of US she filed me and I got my green card
    in January 2005.
    My main concern right now is to call my parents here for a few months
    and if possible my younger brother too. Suggest me the best and fastest
    way to make it happen. If you think it’ll be faster and safer if
    someone with a H1B visa sponsors my parents then I have my younger sister
    in New York she holds a H4 Visa and her husband H1B.

    Please answer the following;
    1.How old is your younger brother in India and is he married?
    2.What does he do in India?
    3..Any other siblings living with your parents in INdia?
    4.. What do your parents do?
    5. Do they have good financial health to finance their own trip to US?
    6. Has anyone of them visited a foreign country before?

      hi,
      my brother is 17yrs old and is studying 10+2 ,and he lives with my mom, there are no other siblings as my mom is alone there and she can support her trip to the US and no one apart frm has ever visited any other country
      if u need any other info plz do reply

        You have not mentioned about your dad and your mother's occupation in India. Both the issues are important.

            It seems you are new to this forum , so let me tell you that widows with little family/occupational ties to India and with children living in US, find it very difficult to get visitor visas.It is flawed thinking that if you have a sponsor , the visa is granted. In fact ties to India carry the deciding weight
            rather than sponsorship.

            There are several posts in this forum attesting to this; and people have applied 4-5 times without success.
            In your case your mother has a tie to INdia in the form of her younger son.
            If both of them apply to go together, with you as a GC holder in US, they
            won't get the visa because they will be suspect not to come back.

            Even with her applying alone, there are no guarantees but
            she can at least try once. Try this strategy;

            1.Let her develop some occupational ties to India over a few months.
            If she cannot take up a job, she should start a small business or a non-profit
            like a charity center, tuition center, or get a documented responsible
            position with an organization in the local community.
            2.Let her show that she will be spending her own money. Make sure she has enough funds to do that. In this case you need not send any affidavit of support.
            3.Let her ask for a short stay say 2 months. Some people just get denied
            for asking too long a stay.
