    Hi,

    My parents were trying to visit since 2005, 1st and 2nd time they applied in 2005 to attend my Graduation ceremony but they were refused without even seeing the paperwork sent by me or the paperwork from them (Ist Visa interview was in Oct and 2nd in Dec, 2005).
    In November first week I tried their visa third time as my status got changed from F1 to H1B1, this time also VO doesn’t even bother to have look on the documents sent by me (3 yrs Tax returns (W2), Affidavit of support), personal letter, letter to consulate and letter from employer. All the three rejections were under section 214B.This time I told my parents to go again (on 28th Nov) and I sent a new set of documents but they got the refusal saying that the law doesn’t permit them to visit to their Son if he is on H1B1.Infact during the fourth interview he looked into all my documents and at the end refused their visa under the same section (214-b). After the interview they really got shattered and now they don’t want to appear again (As far as my parents documents are concerned they showed about 20 lacs Liquid and the home and Agricultural land, as my father is a retiree and mother is running a small business of garments to keep herself busy). As far family ties are concerned we are two siblings (Myself working here on H1B1 and my sister [She is happily married and well settled].
    Could anyone please give me his/her valuable suggestions so next time there is no disappointment. (In all these attempts both applied for the visa at New Delhi)

    I am surprised you let them apply 4 times without any professional advice.
    After the second denial you should have spent a few hundred dollars and talked to a good immigration attorney in US.

    Anyway, the main reason is they do not have compelling ties to India -
    your father is a retiree and they do not have any children they are living with in India. And you sent an affidavit of support which does not go well with their showing good finances.

    You could try this;
    * ask your mom to apply alone. ask for a short stay.
    * Do not send any Affidavit of support. Let her say she is spending her own money.
    * Only send an invitation letter and copies of your visa and passport.
    * Let her apply in march/april.
    * Let her show that her husband is working somewhere after his retirement;
    managind agricultural land or anything else.
