  • to sponsor my doctor brother for B1/B2 or not?

    Here is my question -

    I am on h1b. My 485 is pending - 140, EAD etc approved. I own a house. couple of years ago I had sponsored my parents for visitors visa successfully - they have 10 yrs multiple entry visa.

    My younger brother who is about to finish his MD/MS in India. He has taken step1. He is planning to come here for his CS exam.

    Would you recommend that I sponsor him or he shows parents assets etc? He will stay with me. I will bear his expenses.

    He is plans to apply for the visa before graduating (MD) so he can show the "strong" ties - that he would have to go back to finish his degree.

    Please advice - thanks in advance!

      If he is spending $1200 on step2 cs, the officer expects that he should be
      able to afford a short trip to US and it will go in his favour too.

      Your presence in US on a pending GC petition is a negative factor for him anyway, your sponsoring will be counterproductive.( brother on a gc increases the chances that his doc brother also has GC dreams, and he can help him stay back during his visit for the test,so the officer denies presuming
      immigrant intent ).

      Advice;
      1. Should apply only after he has scores in hand for both step1 and step2 ck.
      Going for step2 cs without ck scores creates a shaky ground for the visa.
      2. People with good scores have good chances.
      3. He cannot avoid mentioning you on DS 156 form (requires to answer Q. about blood relatives, who all are in US and on what visas), but should avoid
      mentioning that he will stay with you. Should provide hotel booking info.
      4. Should ask for a short stay say for a week or so, should get a week to 10 days' leave letter from his PG course.
      5. He will be asked about future plans; should say that he wishes to return
      to India after completing residency. Should show plans of practice;
      clinic site, tentative offer of hospital privileges from a private Indian hospital etc.
