  • Sponsoring Parents...also brother has Green Card

    Hi,

I am planning to solely sponsor my parents and will send the supporting paperwork from my side to them for this purpose. My elder brother is in US too. He just obtained his Green Card a few months ago. We would obviously mention his presence in US, but do I need to send any paperwork from his side too?

Also, I have been here for about 5 years, working for the past approx. 2.5 years now. Is my sponsorship okay? or should my brother sponsor them instead. He's been here for almost 8+ years now.

    Thanking you all in anticipation!

If you mention that you and your brother are both in the US, then they wont grant B2 visa to your parents. Let them play dumb about your brother's status.

I don't think I want to lie. But, could you explain why do you think they will not give the visa if I am truthful?

Do you think it is advisable for my parents to sponsor themselves in my case?

        Thanks!

To the best of my knowledge the US Immigration Act states that if all children are in the US, then you will not get B2, but please call an immigration lawyer and confirm this.

I think it is better your parents sponsor your trip rather than you.... as both of you are in US it may be bit difficult if you and/or your brother sponsors visa.
