  • extended stay of a visitor- tax exemption possible?

    my grandma was here with us for 8months. Can i claim her as my dependant for tax purposes?

    I know that the answer might be a NO. But was looking to find any regulation or specific rule that prevents any such claim.Pls be specific in ur answer. Thanks in advance.

    I don't think you can do that unless she did some baby-sitting for your kids(if any)

      Hi

      Yes,i had my baby while she was here and she did take care of my kid. But she was here on visitor visa. So how does baby sitting for a family member count? can upls elaborate?

        Please do not mention baby sitting as that would be illegal work on B1.

        and as taking care of grandchildren can be counted as one.

        Check the www.irs.gov

        she would be eligible to be claimed as Dependant but it has its associated problems.

          You can't claim people on visitors visa as dependents in tax returns anymore. This is what my CPA advised me 3 years back.

            u can claim them if they can be considered resident alien not to be confused with permanent resident. Search the term on IRS site.

            But they should not be filing taxes anywhere else and the income parameters should be met.

            The W7 will have to be submitted with the returns.
