how to cancel a pending application? pls help.

First of all, my sincere thanks to all those who try to help each other out via these forums..

I will do my best, also... in areas that I am sure of.

Here is my question -

Lets say a person applies for an extension of stay on B2, well within the I94 period. She awaits a response from USCIS, and will be in legal status until she hears back from them.

If she decides to withdraw the extension application, and leave the country,

what are the procedures? consequences?

----If she leaves after the I-94 time ( she will still be legal as she is awaiting the result from USCIS)

---- If she leaves before the I-94 time

There is no form to withdraw the application. You will just have to write a plain letter.

As long as the person leaves the country before hearing from USCIS after filing extension, the person will be considered in legal status, whether departure date is before original I-94 date or after original I-94 date.
