  • Parents visa rejected *** URGENT *** please help.

    Today my parents had visa interview and unfortunately the visa was rejected.

    It looks like the reason was - not enough income/bank balance in India.

    I have an elder brother / sister all are living in India, my parents live with my brother who is employed (financially dependent on him partially), there is also agriculture land and own house in the name of my parents. My father is retired and gets monthly pension. I don't know how much more the financial situation needs to be better.

    the VO didn't look at any of these documents it seems :-(

    If we want to reapply, how soon they can re-apply? what's the minimum time they should wait before re-applying?

    Did you send an affidavit of support or did they say they will be spending their own money?
    Please post the interview in Q and A form so one can analyse the reason
    and rectify in the next app.

    In theory, they can apply anytime but it is advisable they wait a couple of months to show some changes in their situation.

      I am sponsoring their trip, and I did send all the documents from my side properly, the VO didn't even bother to look at the documents. :-(

        I guess you can re apply after 3 days. But take 2 months time and prepare the documentation properly. Even my parents visa was rejected in the first attempt and I wrote a strong letter convincing VO and they were granted visa the 2nd time and they appeared for 2nd time visa in 2 months.

        Letter should say why they would return to India, explain them about strong ties in bullet points (if possible highlight them). Mention in the letter they do not have any intensions to stay. Mention about all the properties, family pictures, return ticket etc. In the letter, if you mention my parents have a house - you should mention documents attached or property deeds atatched). Next time as soon as they see VO, ask your parents to hand over the letter you prepared to VO.

        Say like

        1) My parents have a house (Please find attached property deeds)
        2) My parents have a bank balance (Please find attached documents)
        3) My parents have old parents to take care of (See family picture attached).
        4)......
        5).....

        Mention allthe possible ties like agriculture lands etc.

        That worked in my case.

          thank you for the help.

          yeah, I did write the letter hilighting the main points why they will return to India, but the problem was the VO didn't bother to look at any of that sort, even if my Father asked the VO to look at the documents it seems.
          (probably the presense of Marathi interpreter increased the problem there)

          I'm feeling so depressed today :-(

            May be, if they haven't already done it, you could ask your family to make out an affidavit of return stating all those reasons you mentioned in the letter.

            Also ask them to carry photos of your brother and other immediate family in India and be prepared to show them.

            But you are right, if they reject your parents without even looking at or asking for documents, then there's very little you can do about it.

            I guess you can try taking another appointment (hopefully at another time of the day than the previous interview) and hope that they get to a more open-minded VO this time.

            Prepare your parents to look happy and confident as they approach the VO.
            Andif they are asked why they were rejected they need to clearly state that they don't know why they were rejected since no documents were checked.

              I understand and thanks for the help.

              just one more question - the bank balance in India we show, can my (sponsor's) NRI account balances in India also be part of it, or it has to be explicitly in the name of parents (applicants)?

              I can transfer money to my parents' account but suddenly building up the balance is not a good thing to do. Or may be I can add my Father as a joint account holder to my "NRO" account in India...

              I'm just trying to understand different peoples' experience in this matter.

                Ok, here are the Q&A of the interview:

                VO: where are you going?
                Father: so & so address in US

                VO: who is there?
                Father: my son, daughter-in-law & one grand-son.

                VO: what does he do there?
                Father: he works as a software engineer in so & so company.

                VO: who else are there in India?
                Father: I have another son, daughter-in-law & one grand-daughter.
                (my Father didn't mention anything about my sister and her family. Neither did he tell about anything about my bother - where does he live, his employment - my brother & parents live together in a same house)

                VO: what is your source of income here?
                Father: we do farming/cultivation, have a STD booth and a monthly pension of Rs. 5K.

                VO: what is your bank balance?
                Father: its about 1-1.5 lakh.

                and that's it, then the VO said something in English which my father didn't quite understand and the interpretter told them the visa is rejected. It seems the interpretter was also saying at the end - how can you go and come back with such a small amount... you can re-apply again and come again, etc. and asked them to leave.

                I hope the VO knew the fact that I'm sponsoring their visit, I don't know if the VO was thinking they are going on their own - that's not possible right? because even if they didn't look at the documents, they should have got it from DS-156....

                my father should have told about property as well when they asked the bank balance. and he should have mentiond about my sister who also settled in India

                the Visa rejection code is 214(b).

                  just came to know that my Father did one silly mistake while taking photograph - don't know if that also contributed to the problem.:
                  my Father's natural attire is always a neharu shirt and pajama, but for the photo he wore a coat. I don't know why he did it - he never wore anything other than nehru shirt/pajama in his entire life.
