    Could anyone help, at the moment i`m working in the usa on a HB2 visa, which runs out the end of April, I really to want to stay on with a tourist visa , how do i go about this without having to go back to my home country.

    Do you mean that you have an H-2B visa (skilled/ unskilled worker) which is required by an employee who is coming to the United States to perform a job which is temporary/seasonal in nature and for which there is a shortage of U.S. workers?

    From what I know H-2B visas are only granted for 3-6 months and the INS is very strict about such seasonal workers not overstaying. So if you apply for a tourist visa in the U.S. (without returning to your home country), in all probability you WILL BE rejected.

    A tourist visa is for tourism and you will have to go back to your home country and reapply. Hopefully, when you leave the U.S. before the expiry date of your I-94 then you will be proving your intention to return to your home country and that will help you when you apply for a tourist visa.

    Also, if you want to stay in the U.S. for a longer period of time, go back to your home country and try looking into getting an F1 or H1B visa
