  • i-94 expiry issue

    Hi,
I traveled to US on B1 for 3 months on official business. The last date on my i-94 was March 10. I was supposed to travel back on March 10, but was not able to board the plane due to some problems with my ticket. I left the nex day i.e. March 11. I want to know if my visa is now void under 222(g)? Do I need to re-apply. How can I check the status of my visa?

Also my company is applying for H1 for me, will this be a problem for me? What can I do to rectify this now?

    Thank you.

    Sid

Technically your visa is void because you overstayed one day.
Practically, the only way to determine if it is void or valid is to reenter again on the same visa. And I suggest that is what you should do. Sometimes they let you in due to
"computer oversight". If they stop you , you can explain them what happened
(save evidence. boarding pass etc). The entry officers have discretionary powers to let you in or stop you.

It will not affect your H-1 because your overstay did not invite an entry ban
since it was less than 180 days.
If you do not plan to use your B1/B2 and only wish to enter on a new H-1 , you won't have any problems.
