Family friend of mine Surrendered his Green Card 5 yrs ago and his wife maintained the GC till now, and he wants to visit the wife here and being US citizen myself they approached me!!! His wife's brother is also GC holder but he is staying in the Rehab and US goverment is taking care of him since he is Disabled and divorced. please advise.

Good Question, yes they are living seperately to get her citizenship, she would like to stay longer in US she needs to stay at least 2 more years continuouly, all these years she was going back and forth to India and thus she was not eligle for citizenship.
Answer to Quest 2. my friend works in a Bank as a Manager and he still got 4 more yrs for his retirement. they have well settled Son(Software Engineer) in Bangalore and Well settled daughter in US, due to family issues they don't have good relationship with the Daughter currently and that may change in the future. Since she was home maker in India she was able to make a trip back and forth to maintain the GC and now her intension was to become citizen and sponsor her Son to US and being Bank Manager he was not able get too many leave of absence in the bank he was working at that time to maintain the Green Card of his. I 'm willing to provide more answers if you still have questions and once again thanks for a quick reply.

Since his wife still maintains her gc, her husband will find it hard to convince the officer that he has no intent to immigrate again.
If he has no intent to immigrate any more, and his wife spends a good deal of time with him in India, why does he want to visit US?

Are you planning on lying on your friend's application? Because the fact is even if you sponsor your friend, you WILL HAVE to answer a question in the visa application informing the consulate that his spouse is in the US on a greencard and so is his daughter.
And that means there will be questions about why you (and not his wife/daughter) have sponsored him and the consulate will assume that he/you are attempting to make a fool of them in order to get a visa under false pretexts. It will also make it difficult for him to convince the consulate that he intends to return to India (especially since he has only a few years for retirement that he could easily give up by taking a voluntary retirement) .
I would recommend not playing such dangerous games and not attempting to sponsor the friend.
If he and his wife made a joint decision that she should stay in the US for sake a US citizenship then they needed to be prepared for the separation that the decision would entail.Last edited by smohanty; 03-28-2007, 12:30 PM.

Thus far I have dropped the idea of sponsoring him but like I mentioned in my First Post:
His wife's brother is also GC holder and he is a stroke patient and (he is crippled on the right hand side of the body and not able to walk properly so he is staying in the Rehab and US government is taking care of him (in other words he is using his Medic Aid and Social Security to survive) and literally living in Government Rehab Center, no income or no living space or bank balance and being eligible person as a green card holder can he sponsor for his Visitor Visa for my friend.
I know this is a dumb question and I just wanted to look at the venues to help them out any way I can....
