    Hi,

    My parents visa got refused five times (new delhi consulate) under
    214-b saying that they don't have any strong ties to prove that they will return back to india. I am the only daughter,I am a GC holder and my husband sponsered the trip since I am not working.

    Now my question is that will my son's birthday function invitation help in any case since my son is turning two this july , or a congressman letter can help.
    I know that none of these are sure for getting the visa but just to boost up the case.

    Gurus kindly help.

    hmmmm....Listen to yourself, "I'm the ONLY daughter." By all means ties in India that your parents might have is zero to non. And no.. the Birthday idea will not work. The KEY is your parents need strong TIES in India to assure their return back to India after visiting U.S. No invitation will do. You're the only daughter is the KEY that Broke the TIES. The U.S Consulate will not take that chance. 5 times reject? Enough proves. INA(the Immigration and Nationality Act) stated as visitors under U.S. law,
    "The presumption in the law is that every visitor visa applicant is an intending immigrant. Therefore, applicants for visitor visas must overcome this presumption by demonstrating that:
    The purpose of their trip is to enter the U.S. for business, pleasure, or medical treatment;
    That they plan to remain for a specific, limited period;
    Evidence of funds to cover expenses in the United States;
    Evidence of compelling social and economic ties abroad; and
    That they have a residence outside the U.S. as well as other binding ties which will insure their return abroad at the end of the visit.

      What would help is if your parents could demonstrate that they have jobs in India to go back to, or businesses or something like that, that they have property in India and things like that

        yes u tell them to show land, house etc properties and its only a tourism purpose.let them mention in ds-form for 3 months stay.u can also tell them to show like ur grandmother or grandfather is staying with them and they need to come back and take care of them.this will help out.
