    Hi

    My mother is a widowed housewife and both her children, me & my brother, are on H1Bs in the US.

    She had initially applied for a visitor visa at the Mumbai consulate in Aug-03 which was rejected under Section 214 (B) and then again in Jan-04. The visa officer refused to ask her anything or even let her say anything in her defense. They just told her that since her 2 sons were in the US, they felt that she did not have strong ties to India which would compel her to leave the U.S. upon the completion of their authorized stay.

    I would like her to apply again in May/June but am not sure if they would be willing to reconsider her application. During the initial application we did not show much documents for property, etc. Now we have bought some plots and an apartment which she is managing & renting out to tenants. We are involved in a dispute about an ancestral property in Mumbai. Would this be enough to demonstrate that she would return to India after her visa expires?

    Or would we need to show something else??

    Any & all suggestions are welcome.

    You bought the property and she is just managin it? Or she is part owner? I mean this is a better case still...

    You are talking about a disopute? Is there a court date? That would be good evidence if you could show that there was a court date and she had to attend

      the property is just in my name but she has some other properties in her name. the disputed property is in arbitration to try to avoid any prolonged court battles.

        I don't think they would even look at the property issue.
        In the face of widowed status, no occupational ties and all children in US, property does not carry any weight.

        The only thing she could have done after her denial in 2003 was to start
        an occupation in India ( a registered small home business- music school, sewing school etc--- , or a community organization with some employees)
        If she had run it till now , she would hold a credible argument for the visa officer that she held some occupational ties with India.

        Applying in the current scenario is not advised. She will waste her time and money.
