  • Any suggestion will be a great help - please

    Dear Friends,

I really appreciate if you can take time to throw any suggestion you might have for the following case.

I scheduled my Mom's interview at Chennai in May. Details:
    1. 2000: my parents came to US on 1 yr visa and went back within 6 months.
    2. 2004: my parents came to US on 1 yrs visa (again) and stayed 8 months after extension applied and went back after rejection noticed from INS.
    3. My father passed away.
    4. 2006 Nov : My mom went to get Visa. Rejected citing over stay.
    5. 2007 May: I scheduled her interview once again

I know it's not a likely case to get visa 2nd time, but I really appreciate if you can throw any suggestion may come to your mind to make her case strong.

I am the only son and she currently lives with my sister in India. My Mom is getting pension every month and she own properties in india.

Please please give any advise you might have on this case. Can Congressman/women letter can help at all?

    Regards,

There are several negatives in her app. now. The worst is
staying long periods in US (6 months and 8 months) ,which clearly shows her intent to the officer, that she wants to stay in US as long as possible.

Her widow status and no children in India makes it even worse.
I cannot give false hopes . The best she can do is try to start an occupational activity - small business at home, community organization,
a job maybe in a responsible capacity that will require her to return. Apply for the visa, a year after working in that occupation , maybe she will have some chance.

Letters from congressmen will not help.

Thanks for all your suggestions. I am only son but her daughter lives (my sister) in India.

I know, all these may not help to get her B2 visa. I am USC and can sponsor her for GC from India (which will take a year or two). I have plans of moving back to india by then anyway. We are expecting our baby and it will be great help if she can make it. Does it help at all if you give this reason?

So, it's a last attempt we are trying in May. Yes, she over stayed two month but with proper paper work. Even though we asked extension for non medical grounds, she stayed back to help one of my family member health related issues.

They should see this case as two sides right? 1. she has been to US twice and if she wanted she could have stayed forever 2. She over stayed and they can think she won't return to india.

Anyway, thanks again for all your help. I will post to forum if miracle happens at the consulate chennai :-)

      Regards,
      visa_time.
