  • Visitor Visa question --- help is appreciated

    I am currently working in US with a H1B visa. I would like my parents and sister to visit me for 3 months on a B2 tourist visa. My sister will be completing her undergraduate studies this summer and will be taking up a job in India this october. Their intention is to visit US for 3 months this summer and return back. My question is.... will my sister get a visa? How can I state her case that she wants to come to US as a genuine tourist and will return back in 3 months for sure?

    Any replies is greatly appreciated!!!

    Ask yourself the question "what kind of strong economic and social ties does my sister have to India that convince the consulate of her intention to return".

    As I see her present situation, she has no economic ties (in the form of a really well-paying job) which means the VO will assume that she can stay back in the US to look for work. She also has no spouse/children in India and so has no binding social ties to India which means the VO will assume that she can marry a US-based fellow during her stay in the US and not return. In short, she has nothing to lose and everything to gain by staying back in the US.

    In this case, can you think of any convincing proof of her intention to return to India that she can present to the VO? Why would the consulate trust her willingness to return without any proof?

    In fact, even your parents are risking rejection if they go for the interview along with your sister because when all three of them appear for the interview together they cannot show any binding social ties to India that can prove their intention to return. In fact, when they appear for the interview together the only binding social ties they have is to you, who are in the US.

    Yet, if they do decide to apply together please do send us the details of the interview, regardless of the outcome.

      Thanks for the response. Does this mean that there have been no instances of people getting tourist visa from the sort of situation my sister is currently in?

        I am sure there must be cases where someone in their early-20s got a visitors visa.

        But I am also sure that such cases are the exception rather than the norm.

        I cannot think of one sure fire way by which a person in that age group is guaranteed to get a visitors visa.

        The easiest way for someone in that age group to get a visa is as a student (F1) or as a dependent to a spouse who works in the US (H4, L2). As we are seeing this year, even getting here on an H1B is fast becoming a gamble.
