  • Second visa interview for my mom--Please comment on the case

I am sending my mom for her second visa interview. She got a 214(b) the first time on March 8, 2007. She is an active state government employee.

Major changes in the case are

1)The first time she was planning on visiting for 6 months but this time it is only for a month.

    2) Also, my mom is going to sponsor her trip herself. Last time I sponsored.

My biggest concern is to show that we have enough reason to apply for second time so soon.

I work for a multinational mining company called Rio Tinto. I am in the graduate development program in this company. As a part of this program, I will be in USA for three years and then I might go anywhere worldwide. This is my 1st summer with the company in US, the next summer I am going to India to get married and the summer after that I may not be in US. And as my mom is a government school employee she can visit me/US only in summer. So, its now or never for my mom to come to USA.I took a letter from my company mentioning the same that I may not be in US after three years.

Does that sound a good reason to apply for second time???

Sponsored for sister - visa rejected, what has to be done?

I sponsored for my sister tourist visa to visit US for a period of 1 month, she attended interview today and her visa was rejected. All the paperwork was right, the reason for rejection was that she is a student. She had enought proof from her college that she will return back, but still was not issued visa.

Can she go for a second interview. what are her chances of getting an visa, what should she say to the interviewer. how many chances does one have to apply for an visa.

    Please let me know.thanks.

A letter from a college is NOT convincing proof of the applicant's intention to return because it is so easy to drop out of the college once the applicant gets the visa or gets to the US.

The VO would assume that since she has strong ties to the US in the form of an older, well-established sibling, the applicant could stay back in the US to study, work or marry.

To nullify this assumption the applicant needs to show strong economic ties (a very well-paying job) and strong social ties (spouse/children) in order to prove her intention to return after a visit. But in this case, the applicant cannot show either.

So then I am not sure of what new evidence of a changed situation can she present at a second interview that would prove without doubt to the VO that she intends to return?

The best/quickest way for a young applicant to come to US is by completing 16 years of formal education, getting admissions to a US university and applying for a student visa. The other option is, of course, as a spouse to somebody working in the US.

And if she is hoping to apply for a student visa sometime in the future then it would be safer for her NOT to risk visitor visa rejection again in case it later weakens her student visa application.
