  • How long should one wait before re-applying

    Last week my sister's Visitor Visa got rejected the at chennai consulate with the reason being "potential immigrant". This was the first time she ever applied. How long does she have to wait before re-applying? Can she apply right away?

    In theory she can apply after 3 working days; In practice, she should wait for a considerable period so she can show some significant changes in the reason for denial.

    Describe her interview when she was refused. Also
    post here the following
    *Is she married with kids?
    *Her education and job?
    *Her salary and financial status ??
    *Purpose of visit to US?
    *What is your visa, job status in US?
    *Did you send an I 134 for her?

      Sisters VISA

      My sister had put down 'parent' as sponsor so had neglected to carry hers and her husbands correct financial details. and the consulate member wanted to see hers and thats where she must have lost out. Also she was waiting for the member to ask questions but he dint ask many q's related to her stay and hence she was also not able to communicate properly her intentions of a holiday visit only.
      Is she married with kids? Married no kids
      *Her education and job? MA english literature, working as an English Lecturer
      *Her salary and financial status ?? salary not great but she has additional income in the form of rent, her husband is also a dentist.
      *Purpose of visit to US? Holiday and visit to the US
      *What is your visa, job status in US? Home maker, permanent resi, husband software engineer
      *Did you send an I 134 for her? yes.

      she has vacations till the end of june so she would like to try again and come for a month atleast.

        She can try again with the following in mind;
        *she will be asked why she came back to reapply so soon after the denial. She should say the summer vacation is the only time she can go and that she wants to emphasize that she is a genuine visitor.
        *she should self-sponsor if her husband is earning 9- 10 lacs per year. Meaning she should write that her husband is paying for the trip. You need not send an I-134 in this case. She may be asked why she showed the I134 the first time. She should say she was under the impression that it was mandatory.
        *she should show employment cum leave letter from her college showing her salary and that her employment is permanent. If it is a govt. job , she will
        need an NOC from the govt.
        *she should show her husband's practice registration , his IT returns and bank statements.
