  • B2 visa for in-laws, akl

    Hi,

My wife's mom, her stepfather (I will refer him as father-in-law for the rest of this message), and her half sister are planning to visit my wife and me. My wife and I were married and had a traditional wedding back in China on January 2007. We also have a valid State of Colorado Marriage Certificate.

My father-in-law holds a good position in the Chinese government. My in-laws have their own property and could demonstrate their finiancial stablilty in China.

I have been reading up on how to sponsor them to obtain a B2 visa. I totally would not mind to sponsor them.

    My questions are:
    1) Do I need to be sponsoring my in-laws for the B2 application? It seems like they have enough collateral back in China to prove that they will not be a public charge to the US and they will be able to support their visit. They also can have enough reasons to show there is no intend for them to stay in the US.

    2) Will my wife's half sister (8 year old) add complication to this process?

    3) I am not clear on how much money I need to have in saving in order to qualify. Frankly speaking, I do not usually have a large amount of money in the bank. I usually have 5000 in there only. However, I do have life insurance policy (with surrender value), retirement accounts, and four rental properties (all positive cash flow).

I have been reading up on providing a bank statement if I were to sponsor their B2 and I have read about rules that I should have 5000 for each person that I am sponsoring for. I want to know if I can prove my financial strength with my other assets.

    4) Also, I have read that you should not deposit a large sum of money right before the application. I was planning to reallocate my asset from somewhere else and deposit the cash into my bank. Is this a bad idea?

Please provide any advice you might have.

    Thank you very much!

If your FIL meets the criteria for self-financing the trip , he should do that. It would go in his favour and free you from showing any finances which are in a doubtful state. I do not know about china , visa officers in India ususally
have a cut off annual income as applicant's self financing criteria, a hefty bank balance alone does not suffice. You should talk to people in china about the income issue.
In such a case, you do not need to send any sponsorship; all you need to send would be an invitation letter
from your wife to her parents , her visa and passport copy and her birth certificate showing her parents' names.

About her half sister, they have to show that she would accompany them. It is very natural for an 8 yr old to travel with her parents. Unless they have other older children to take care of their sister in china.
