  • Quick question on I-94 Expiration Date for an AOS Applicant

    Dear members,

    I am new to this forum and I have a quick question on I-94 expiration.

    I filed for Adjustment of Status (I-485) and I currently have a valid EAD and Advance Parole. However, my I-94 has the expiration date of May 08th 2006.
    I invited my in-laws to US and and I want to know if this will be an issue when my in-laws visit the US consulate for visa interview.

    My current EAD is valid till October 2007 and I have Advance Parole that is valid till November 2007.

    It could be an issue. Not the I-94, but the fact that you are adjusting status in US.

    YOu need to plan a strategy for inviting them. Please answer ;

    What visa did you enter on? When?
    What does your wife do? What is her income?
    What is her visa status?
    What is your basis for change of status?( employment, family)
    How many children do your in-laws have in India and how many in US?
    Married or single?
    What do in laws do? What is their income?

      I came on H1B in 1999.

      What does your wife do? What is her income?

      She is presently not working.
      What is her visa status?

      Her status is same as mine. She is an AOS Applicant.
      What is your basis for change of status?( employment, family)

      Employment.
      How many children do your in-laws have in India and how many in US?
      Married or single?

      They have an unmarried son in India. None in US.

      What do in laws do? What is their income?

      My Father-in-law works for Central Government as an Administrative officer. Income will be around 3 lakhs per anum.

        They have ok ties with India but there is a lot of hit and trial in the visitor visa sytem.

        Some officers would not care but others would say, " your daughter is adjusting status in US , so you might too."

        Can you wait till you both get your green cards?
