  • how long can she stay?

    hi,

    my 69 yo mother from the philippines git her visitor visa yesterday for multiple entry (10yrs). now my question is, how long can she stay here in the USA? I am going to book her a ticket online and she wanted to depart like june 1st. what should i have to put on her return ticket cuz im confused? she wanted to spend christmas and new year here with me as her daughter and grandkids. is that possible?

    pls advise.

    The actual allowed duration of stay is decided by the officer at Port of Entry. Depending on what the reason for the visit is, a maximum of six months is allowed. One should make plans to return before that date. Assuming that a six months stay is allowed, it is better for your mother to start in July with a return ticket in January.

      thanks for your prompt reply, appreciate it. However, since her POE will be in Los Angeles since her bro my uncle is the one going to pick her up ( I live in Mid-West), and me and my hubby and kids will see her in California on the day of my newly born son's baptism which is set on June, will this be a cause of prob for her since her bro is the one going to pick her up or not at all? Lastly, I cannot book her for a July departure since my newly born son will be baptized on June 10th. Lastly, I will book her flight on June 1 departing Manila, Philippines, what date should i have to put on her return? My mother is dying to spend xmas and new year here in the USA basically bec to experience the cold snowy weather here. Oh and one more thing, when do you think is the best time for her to come back here in the USA?

        I forgot to include this ques earlier on my post. If i booked her ticket good for six months then the immigration officer at her POE decided to trimmed it down to 3 months, what should i have to do on her air ticket? thanks again

          Hi,
          It does not matter where the POE is. You only have to make sure that your mom does not violate the limit (for stay) set by the officer or it may be difficult for her to enter the US again. In fact it has been suggested that one leaves the country a few days before the date so that in case there is any delay in flights and things such, one will still not have violated the limit.

          A start date of June 1 will mean that she will have to leave the US before Dec 31 (assuming she is allowed a six month stay). May be you can consider changing her start date to atleast a week later so she can be there for the new year. This is just a suggestion. But as I said adhering to the stamp is important.

          The gap between two subsequent visits should atleast be six months. Or it may be difficult to satisfy the officer at POE of your motive.

          About the ticket, I think you can consider booking the ticket with an airlines that allows one change in the ticket free of cost. There are airlines that do that I hear.

              how to apply for an extension?

              HI all,

              I heard about this filing for an extension of stay as a tourist visa. Say, i booked my mother's flight leaving Philippines on June 1st good for 6 mos (December 31, 2007), and 1 month before her 6th month will be expired, i intend to apply her for an extension.

              1. How to apply for an extension?

              2. How long is the maximum period of time should i have to put on her application?

                Beware 1st June to Dec 31st is 7 months not 6 ... Calculate for ur self. And the regulations say 180 days not 6 months.

                  Yeah, thanks so much, im so confused because of excitement i guess.

                  Now my question is since her 180 days will be on November 30, 2007,

                  1. Please tell me on how to file for an extension?

                  2. How long is the maximum length of extension that the USCIS will allow my mother to stay here in the USA?

                  3. Is it possible if I could request for another 90 days since she wanted to spend christmas and new year here in the USA for the first time and February is my son's first birthday and my daughter's birthday as well.

                  Need some enlightenment please.
