    My Parents Have One Year Multi Turist Visa (from Aug.06 To Aug.07). They Have Been In U.s. For The First Time For A 6 Months Period From Sept.06 To March 07.
    They Are Planing To Come Back In The U.s. Again By First Week Of June.
    Does The Immigration Officer At The Port Of Entry Has A Way To Find Out , That They Left U.s. In March This Year And- Are They Going To Create A Problem By Coming Back In June?

    Yes, he has a way of finding out. The Indian arrival stamp in their passport.
    And their computer can show the departure date as well if they deposited their I-94 while leaving.

    If they want a 10 yr visa after the expiry of their one year visa, I strongly suggest they avoid coming in June. Even if they are allowed entry, the embassy officer will certainly refuse them another visa when they apply again, due to their stay and visit history ( long stay of 6 months and two visits in 12 months suggest that
    they want to live for ever in the US).

      What do you think...that the INS does not keep detailed records of who enters and exits the US and when?

      Of course, they have detailed records and (as Peace mentioned) the date they left the US in March and arrived in India are both stamped in your parents' passport. So anybody who looks at their passport can figure out when they were last in the US.

      The US visitor visa is primarily for tourism. And that means that visitors/tourists to the US need to spend more time in their home country than in the US.

      Now, in the last year, your parents have spent six months in the US and three months in India and now they are returning. So obviously they have spent more time in the US than in India.

      Also, six months in the US is generally more than enough to visit places and meet ones relatives.

      So obviously this upcoming visit is really going to hurt their record. They could face some tough questions from the Immigration Officers at the POE regarding the purpose of their visit and how long they intend to stay. And the reasons they give for the purpose of their visit three months after their last visit ended better be very very convincing.

      It is possible that your parents may perhaps be allowed to stay for a shorter duration - like 3 months, 1 month or 6 weeks.

      And regardless of the duration of their stay (even if they are lucky to get 6 mnths) they will have serious difficulty getting a US visitors visa the next time they apply.

      You see most older people who convince the US consulate of their intention to return get 10 year visas.

      However, your parents were only given a 1 year visa probably because their case was not convincing. And now any suspicions that the consulate had about your parents' case is going to be reinforced by their return to the US so soon after the last trip ended.

      So do let your parents know that this upcoming trip just may be their last trip to the US in a long long time.

        Hi,

        Its amazing how people can be so greedy. I mean don't people know that the visitor's visa is meant for coming to US for a shrot period of time. I mean people who overstay and people who plan to misuse the visitor visa should not be given visitor visas ever again. They have no idea what kind of problems it creates to people who have a genuine intent of visiting US.
