Dear Peace and other Senior members your help is needed

Hi,

My parents were trying to visit since 2005, 1st and 2nd time they applied in 2005 to attend my Graduation ceremony but they were refused without even seeing the paperwork sent by me or the paperwork from them (Ist Visa interview was in Oct and 2nd in Dec, 2005).
In November first week I tried their visa third time as my status got changed from F1 to H1B1, this time also VO doesn’t even bother to have look on the documents sent by me (3 yrs Tax returns (W2), Affidavit of support), personal letter, letter to consulate and letter from employer. All the three rejections were under section 214B.This time I told my parents to go again (on 28th Nov) and I sent a new set of documents but they got the refusal saying that the law doesn’t permit them to visit to their Son if he is on H1B1.Infact during the fourth interview he looked into all my documents and at the end refused their visa under the same section (214-b). After the interview they really got shattered and now they don’t want to appear again (As far as my parents documents are concerned they showed about 20 lacs Liquid and the home and Agricultural land, as my father is a retiree and mother is running a small business of garments to keep herself busy). As far family ties are concerned we are two siblings (Myself working here on H1B1 and my sister [She is happily married and well settled].
Could anyone please give me his/her valuable suggestions so next time there is no disappointment as I am planning to send my mom alone this (June last week) time as my Father recently joined a company as consultant .Is his new job going to be a negative point, does my should tell VO that he is not going because of job or should she tell some other reason as definitely VO is going to ask this Qs that y ur husband is not going this time.
Please advise me the right answer for this and what documents my mom should take to prove my fathers new job.
I appreciate your valuable suggestions.
(In all these attempts both applied for the visa at New Delhi)

You should have sent your mom alone in the 2nd or 3rd attempt because the main reason for the denial is retired dad and no child in India that will bring them back( married daughter is not a compelling reason to return).

It would have been wiser to let him spend some months in the company and then let your mom apply . Since she already has a june appointment , she can say he is dejected by 4 denials and does not wish to go now. She can also say he has a new job now and show the company letter confirmng his appointment.
She must show her business documents and show who will be running it in her absence.
And she should ask for a short stay; 3 months .

From my experience, so far, I think the Visa Officer's thinks that your parents will not return because as per Indian Culture, Son is the one who takes care of the Parents in their old age. So there is a high chance of your Parents settle down with you. I have the same situation. My mother is going for the second Visa interveiw next week. I will post my experience if she gets a Visa.

Try to show proof that they don't have anybody else in US and all of your parent's relative are in India and they enjoy staying in India.

why dont you make your parents sponsor themselves. I think that is a good idea.

I have done the same, I expected the VO to look at the documents if they sponsored themselves which clearly shows that they are not at all dependent on their son or who ever it may be.
