    Hi All,

    I am a USC and my Mom's B1/B2 is rejected twice. I am wondering, are there any grounds on which I can get my Mom to U.S on tourist visa being a USC?

    I mean, to think of it, if I really want, I can sponsor my Mom for GC and in a year or so she can permanently be here. But all we need is for few months.

    I think sometimes, counselors are dum that they don't see this for some reason
    and they don't give a chance to even talk.

    Just wondering if I can contact some immigration lawyer etc can they help?

    No, no lawyer could do anything. B1/B2 is designed to be very discretionary and the officer's decision is not open to appeal or challenge.

    It is obviously flawed ; why cannot a parent of a USC have a non-immigrant intent so as to qualify for a B1/B2 visa but like many other flaws in life we must live with it.

    I advise you stop wasting time , money and your parent's self respect on visitor visa apps. Just get her a GC. There is another reason to apply for
    her GC now. There is a bill pending in the senate that will put a cap on parents GCs IF IT PASSES. So, just do it. File an I-130 for your parent asap.

      Thanks a lot Peace for your quick response.

      For applying for I-130, do I need to have my mother's birth certificate or those are needed only at the time of Interview. All I need to apply is just I-130 to start the processing?

      BTW, the reason, I am hesitating for her GC is, we are going back to India next year. If I apply for her GC now and then if she doesn't stay then we need to surrender GC.

      But later in life, if we ever do come back to live in US, then I can again apply for my mother GC second time? Or they deny at the time ?

          Mother's visa

          Hi All,
          I am in the same boat. My mother visited US twice before and left India in time (she got single entry visa both times) and got rejected twice now (once in Jan06 and Feb07). The only reason for rejection we could see is we are two brothers and both are living in US and my mother is a widow. So they could see her as a potential immigrant. I became a USC after my mothers 2nd rejection and planning to appy for a GC for her asap. I am hearing the following versions from people I knew,

          1. I could apply I130 and go for consular processing
          Or
          2. Apply for Vistor visa again and if she gets the visa then apply for 485 in US

          So my questions are;
          which option is better?
          what are the actual steps needed in option 1 after I-130?
          If I try option 2, what would be the best way to approach? Should I go for a Senator recommendation?

          Also I am visiting India in July so I want to make a quick decision on the options.

          Any input is greatly appreciated.
