    Hi my mother who is on visitors visa is finishing her six months on June 30. All along I was asking her to extend her stay but only last week she agreed to extend. So I have put in I-539 with the guidance of tips form this very useful web site and also extended her health insurance from this site.

    She had her ticket to fly back from US.

    She also has one year of visa to Canada and she stayed this last month with my sibling at Vancouver. She is back in the US.

    At no cost I want to jeopardize her multiple entry visa. So I will have her leave the country before june 30 so she does not become illegal. She is planning to go back to Canada and stay for 2-3 months and then if she does not get extension leave to India. So that he multiple entry is still valid. If she gets extended she can come back to US to stay with me. Is this a good plan ?



    Now the question to the well informed on this site

    1.Does she have to return I-94 only at the airport or can she still do it at the border on the road when she goes back to Canada.

    2.Can she safely stay here some more time and then leave after 3 wks ? thinking that the I -539 usually would not be processed so early so that she does not have to worry about the decision.

    if she leaves the country before she gets decision of extension request then her request is void. If she is planning to stay in Canada anyways for 2-3 months she will be issued a new I-94 on reentry.

    So save money for extension and send her to Canada for 45-60 days.

      As it is mentioned in the forum. is it not going to canada does not give you new I-94. You have to atleast get out of north america.

      But you bring a good point. submiting the I-94 will void the extension request. Is that for sure ?

      But my real question is to give the I-94 back does it have to be air port or it can be done at the border with canada ?

        I mean giving the I-94 at the border while going by road VS giving the I-94 at the airport while leaving US. so that there is documentation of leaving the country while in legal status still. Is there any difference ?

          1) If you leave the country while the I-539 is pending, yeah, it is assumed you decided to abandon the extension

          2) If your mother goes to Canada and comes back in 2/3 months, I sincerely doubt she's gonna get 6 months on her I-94 - she might get one, two - or if the border officer isn't in a good mood, might send her back the way she came - specially considering she already stayed 6 months in the US. Smells of illegal immigration

          3) I've done the US-Canada trip multiple times - for business reasons by plane, for tourism by car. By air, I did surrender my I-94 every time. My I-94 was never kept by a border officer - not even once. I never asked either - it was always short 1/2 weeks trips.

          I don't have any proof, but I think the border officers DO NOT collect I-94 on the US-CAN border for the reason stated before - to prevent people from bouncing back and forth between the US and CAN to 'extend' their stay in the US.

            Thanks Mickey for sharing your experience.

            Mom is travelling to canada not to get extension. I am not expecting them to renew the I-94. That is why I have applied for the extension already.

            I can understand border officers not giving new I-94 while returning but why does they not take the I-94 back to document the exit ?

            Anybody has the answer ? How about the Administrator can you give your valuable opinion.
