    Hi,

    INS asked the additional document for my parent's visa extenuation and asked to send document before Sep 18, 2007.

    We applied visa extension on Feb, 2007 and asking to extend to Sep 10, 2007. Also we sent the original I-94 to INS

    My parents plan to leave USA before Sep 10 which we asked to extend, no matter if the application is approved or not. We have purchased the air tickets to leave USA at Sep 7.

    I have few questions for this case:

    1, If we send the required document to INS around the early of Sep, and they leave USA before Sep 10. We will not get the original I-94 back.

    Can they leave USA without original I-94? is there any bad effect for this case?

    2, If we send the required document now, we may get response from INS before Sep 10. It will be good if the application is approved.

    In case of the application is rejected,
    normally how long my parents need to leave once we received the notice? Is there specific date or period to prepare for trip?



    Could you give me the suggestions which way is better or what is advantage or disadvantage for that?

    Any advice or suggestions are appreciated!

    1. That's OK. That is the best you can do now that you sent original I-94 by mistake.
    2.There is no grace period. Whether they leave within 1 day or 1 month, they will be considered out of status.
