    Hi,

    Please let me know what are the options to get my fiance visit me in the US. im not sure if B2 or which is the right and feasible way and what are the requirements from my end to sponsor.

    Currently he is an indian student in UK.

    I could also use some help with having my fiance visit me (or even stay, without having to be married in 90 days), though she is from the Philippines. Any assistance at all would be fantastic. I am a U.S. citizen.

      If you do not wish to marry her in 90 days then your fiance can visit U.S. on B-2 visa and can stay with you. All you have to do is you can send her an formal invitation letter from your side and Affidavit of support if necessary. But if you intend to marry her within 90 days then you can apply for K-1 fiancee visa. After getting into US your fiance can apply for Green Card immidiately after the marriage. on B-2 visa she has to leave US on expiry of the Visa.

        K-1 visa

        Diya, you can get your fiance through K-1 visa option which is specially for Fiance(e). But for that you have to sponsor your fiance, in the sense you have to file a petition with INS regional service center in US. After your petition is approved your fiance can apply for visa from UK itself as a Third Country National.

          But can you please clarify again if i ( indian on H1B here in US) can file a petition for K-1 for my fiance ( indian student in UK) ?

          this will be every hepfull .....

            Thank you for the help. Unfortunately, she has been denied twice for the B-2 visa. Those times she was simply applying to visit her family here in the U.S. for christmas. Since I do not wish to marry her within 90 days, is there any other option I may have in order to get her here relatively quickly?

              K-1

              Diya, K-1 is only for U.S citizens to bring their Fiance(e) to get married within 90 days of their arrival. In your case if you are citizen of US then you can but if not as you have specified you are on H-1B visa, your Fiance can come to US on B-2 Visa by way of Third country National visa as he is in UK, for which you can sponser him file a petition at INS regional service centre.

                you can avail K-1 visa for your Fiance. for that you have to sponser her and file a petition at your nearest INS regional service center. It is not mandatory that you should marry in any circumstances but if you both are not getting married within specified time of 90 days then your fiance should depart from U.S. you should mention that you are about to marry your fiance in the petition and visa application.

                  Ok, cool. If we don't get married within the 90 day period, and she applies to come back at a later date, would that fact hinder her ability to get approved for another visa?
