  • Re-enter the US

My in-laws have a 10year visitor visa. They stayed with me from March07 and thay will be returning back to India on sep07. They would like to visit their son in California and they want to come back to the US during Nov07. Will they have any issues.
    1) Will they get to stay for 6months.
    2) Will the Immigration officer create any problem, since they stayed in the US form Mar07 to Sep07.

    Regards
    Vag

Please me considerate and respect the visitor visa. It's not meant to be mis-used. It's really because people misuse and keep visiting their children before 6 months, it affects visa issuance for visa for other parents.

They need to stay in their hometown longer than they are in the US. So yes, if they try to visit again so soon then there is a high chance that at POE the officer might deport them or go as far as canceling the visa.

Yes, they most probably will face problems. Recommend them to stay out of US for atleast 6-12 months. Otherwise they will be 'living' in the US on a visitors visa and not 'visiting'.

Visitor Visa - Visitor - Visitor - Visitor

As the visitor visa says, it's for visitors. Visitors are those who live in their home country and VISIT other country or countries for a short time.

If this is your parents' very first visit to the U.S. and they return back very soon, expect issues at POE.

However, you can surely take the risk if they have a "reasonable" justification to re-enter United States so quickly.

It's your risk for the taking and which may jeopardize their future visits too.

As someone else rightly pointed out, if more and more people start doing this, everybody else will be affected. Please do just think of being considerate.

        Good luck and best wishes.

Do you know of any cases where someone has been rejected for trying to enter the US with less time interval between 2 visits?

Rejection - no! Difficulties - yes

If you already have a visa, there's no rejection and usually the border patrol does not deport you back just because you re-entered in a short time.

Of course, this is true, if all your documents are in order.

They may give you a very, very short stay on the next re-entry, which may even be for one or two weeks only.

The bigger issue arises when you go for your next visa when this one expires. That's when they scrutinize closely and may reject it if they find too many anomalies.

            Good luck.
