  • So i mailed in my i-94 :(

    I filed for an extension a couple of months ago, and got the receipt, which has june 6th on it as the date, so i guess i'll be expecting the answer in mid september.

    However, i've been to see an immigratino lawyer, and she said that as soon as when i receive the answer, which might be much sooner than indicated on the uscis website, i am out of status.


    I have two things that are worrying me. First thing is, how do i solve the out of status question, since i've already post poned my ticket to oct. 2nd when i have to be back to start school. What hapens if i'm denied a week or two weeks prior to that?

    Also, what should i do without my original i-94.


    I kept calling the USCIS office before i did any of this stuff, and they told me that i should mail in my original and that i have 30 days grace period to get out if im denied.

    It is unclear if you are talking about a visitor visa or a student visa??? You need to write about your case in a more clear manner with enough background information.

      I've posted in the tourist section, i thought it goes without saying that i mean a tourist visa.


      I'm here on a tourist visa, which was good for one year and has expired on july 5th this year. My i-94 was stamped for 6 months and it expired on june 18th.

      I filed a petition for an extension, and got the receipt with the date of 6th of june. And now i am waiting for the answer.


      1. This website claims that there is no grace period and that you're out of status as soon as you get a denial. An immigration lawyer that i've consulted said the same thing.

      2. I had a bizzare conversation when i called the USCIS number today. The guy was really positive, he cheered me up, and he said that there is infact, a grace period.

      3. This just occured to me, my visa has expired, and if someone was to look in my passport right now he would see an expired visa. I vaguely remember something about visa not being important in this case, and that everything depends on the i-94, is this true?

      4. I've mailed in my original i-94, as it said in the form. What should i do now.


      5. The person also said that i should be receiving my answer by 5th of september, which would give me another month to get out, i've currently have my flight booked for 2nd of october. Should i worry?


      I am losing hair here, i thought that i've covered all angles so i do not do the wrong thing, but it seems that i already have. Please help!

        hey

        don't worry about ur original 1-94..if u do decide to leave..its alright that it's not with u. They won't make a big fuss about it..just say that u planned to extend but the approval hasnt arrived yet..and u want to leave (if this is your plan) without knowing the results of the extension.

        I went to the US with a tourist visa (valid for 10 years) last September 2006 and they gave me a 6 month visa...i applied for extension January 2007...it didnt arrive till last week of March 2007. So i ended up going home not knowing the results of my extension of stay. I submitted my original i-94 (which is dumb...next time just send a photocopy of it) and it was fine that i didn't have it.

          Another I-94 @ a'port

          When you're leaving the U.S. they will get another I-94 and use that as a record of your departure.

          Sometimes, even though the card is stapled to the passport, people do lose it and they don't make a fuss about it.
