    Hi,
    I am currently in the process of getting my green card and wish to invite my aunt from India to come to the US. My husband has just recently received his green card but mine is yet to be approved. I am currently on H4 visa expiring in June, 2008. In such a scenario, what are the documents required to sponsor a visitor visa for my aunt. Please advise whether I should send my green card application form plus documents of my H4 visa?

    First point since your husband has Gc and is no longer H1 you cannot be H4. But you are AOS. so the documents you will need to provide will be your husbands GC and your I-485 receipt, especially if he will be sponsoring.

      Your aunt's visa application will first be assessed on the basis of her ties to India ; that is the most important issue. Your sponsorship is secondary
      and may even be counterproductive.

      Please provide the following info for correct advice;

      What does she do in India?
      What does her husband do?
      How many children/ what do they do ?
      What is her annual household income?
      Has she applied for a visa before?
      Has she ever visited any other country before?

        tx for the reply..My aunt has never travelled abroad before but has sufficient ties to india. She works in a bank and my uncle works for a pvt. firm. My uncle and cousin would be staying back in India so that should prove good ties to india. also she has property and her extended family there. we are only going to apply for a 1 month visa. what do you think are her chances. i intend sending the affidavit of support as a back up.

          Income? Even if you send the affidavit of supp., their household income in India is a major factor deciding the visa . Officers thnk people with good income are more likely to return. And showing an affidavit of support indicates to the officer that one is not financially sound in INdia and is thus asking for support from the host. I'd suggest if her household income is 10 lacs+ per year , she stands a good chance.
          It is very important that she take all documents proving their income; own and husband's salary slip, IT returns.
