IMPORTANT, VERY NEED HELP. about double case. please

Hi. First of all I would like to thank to everybody whom may read this. I really need help. So please don't hesitate to follow my story and I hope someone really can help me. Please.. Thanks in advance.

I came here to US, since Nov 2006. My I-94 expired on May 2, 2007. I applied for B2 tourist visa extension on April 2007. As I understand that I may stay lawfully while my case still pending; on late July 2007 I filed my 2nd case -- that is exchange of status to F1 visa. Because I was accepted on Master Programs here in CA. Using the same I-539 (to extend stay/exchange status).

My problem is, really big problem, that my 1st case already got denied the letter of denial is written on August 13, 2007. And according from the letter I should depart from US within 30 days (my deadline is September 10).

But I still have my 2nd case pending (my exchange of status to F1 visa).

My questions are (please help me, i'm really sad and need input):
1. Should I wait here (stay in US) for my 2nd case result? Will I still have legal rights to stay here in US, while my 1st extension case had been denied?

2. I have B2 5 years tourist visa, is that true that when I depart from US, they will VOID my visa (no longer use) even though they don't stamp it?

3. If I go back to my home country (Indonesia), will I be able to apply the F1 visa from there?

4. When I go home, what are the things I should do, to make me eligible to come back anytime to US, or to be successful later on to apply the new Visa?

I just found this web and forum today. I really really hope, someone would be able to give me some helps, suggestions, and opinion.

What you should do;

Leave before sept 10 and you will be safe. You can enter again on your
5 yr B2 after some months and you will be allowed in because you left timely
within 30 days. When you enter next , bring the denial letter and your boarding pass for US departure to prove that you left timely. DO not apply for an F-1 at indonesia after leaving , It will be denied and your existing B2 cancelled, because you applied for an extension.

You should not wait for your 2nd change of status response
because you have already received orders to leave country and the second I-539 will not be processed. It will be your biggest mistake if you stay beyond sept 10 because you will not be able to reenter on your B2 ( it will be void) and you will not get another B2 or F-1 because you defied the orders and overstayed. Mere applying for an extension
makes the officer at embassy deny another B2 or an F-1; overstaying is a definite no-no for another visitor or student visa.

First of all thank you so much.

But, as you said that I can re-enter US again for some months? How many months it should take?

At the time, I leave US on Sept 10. They will VOID my 5years B2 multiple entry Visa right? Will they VOID it? It is written on USCIS.gov, and immihelp.com clearly. Should I re-apply for another new visa to re-enter US again?

I found this on immihelp.com ; that once I go home, I should send to USCIS California Service Center these files:

-original denial letter
-original boarding pass
-copy of biographical page of passport
-copy of entry stamp in new country
-letter explanation of overstayed

Should I really do this? because you said, I need to show this upon the next arrival to US (if I re-enter)

You told me not to apply the F1 visa from Indonesia (my homecountry). What should I do if I want to re-enter US, and if I want to study in US, since I got accepted in Master Programs here?


I'm so sad now, all my Master school plan just destroyed over the night. I found a lover here, but we can't marry. And it so devastated to leave like this now.

Everything feels like hell to me now.

Please help me...I'm so need it.

Your visa is NOT void if you leave within 30 days.
and you can enter again on your B2 after a safe gap ( 3-4 months).
You do not need to send anything to california service center.
You should carry the papers I told you just in case they ask you at entry.

So. I think I should leave from US soon this Sept 10, 2007.

peace should I or can I apply for F1 visa from Indonesia right away, once I get back? What is the most safe time for me to apply the F1 visa after I get back home on September?

If as you say I should wait for 3/4 months for safety. Should I apply my F1 visa after that time then?

Or what is the best thing I should do?

I'm also entered US under "Special Registration", and when I came here back then, they told me, if later I go back to my home country - I should report and do the interview on the special office at the airport.

My questions are:
1. What is the best answer explaining why I extended my visa here in the US?

2. When I applied the F1 visa later in Indonesia (home country), what is the best answer when the US embassy officer ask me during the interview?

3. When is the most safe time to apply the F1 visa after I go back on September 10 - Sept 13 (arrived)? Since my school will start on January 7.
