  • my mom visa got rejected

    Hi i am so upset today My mom visa got rejected. she had Green card, but didn't maintain the status. Vo even didn't look at it. I don't know what to do. should i apply agin for her and tell VO this time that this is my green card and she does not have any intention to stay in US. will it make any difference. we are four brother and sis in US out of SIX. but both my brother are student so they can't afford or parents can't live with them. what you guys suggest me to do. should I apply for my dad too this time so that he can atleast talk to Vo. it seems like my mother was waiting for him to ask or see paper and he even didn't look at that he simply ask how many children are there. That's it.
    Pls help me guys

    frankly , it is going to be a hard road for a visitor visa for the very simple reason that she has 4 children in US. you read this forum and you will see parents being denied 4,5,6, times. There is no silver bullet that will get her the visa. Visitor visa is all hit and trial and very very uncertain.

    I suggest you guys look at the gc options instead of wasting her time , money
    and mental strength on a visitor visa.

    +When was her last trip to US on her gc?
    +Why did she let it lapse?
    +What was the basis of her getting the gc? Did any 4 of you sponsor her for her gc?
    +Is anyone of you a US citizen or going to become one?

      my mother last visted in 2000, she has no intention to live in US and both of her son is student so can't come and live with them and we both sis came here after marriage. she lapse her green card coz my father has lot of property there and one sis and one of my brother is there in india. My uncle sponsered their green card. one of my brother is citizen but my parents does not want green card coz they have no intention to come and stay here. they just want to visit.
      pls give your suggestion guys.

        my sincere advice to you;
        forget about visitor visa for her. She has two major negatives for a visitor visa;
        *prior green card : even if it is lapsed the officers think she is a POTENTIAL immigrant because she immigrated once.
        *4 kids in US.

        Be smart;
        She should take the green card route. SHE DOES NOT NEED TO STAY IN US PERMANENTLY WITH THE GREEN CARD. She should spend a few months every year in US and most of the time in India.
        Even with a 10 year visitor visa she would do the same , so gc is a better
        option. Ask your US citizen brother to file an I-130 for her and she will get the immigrant visa in India within a year.

          thanks peace for your advice. I have one more question My brother is Student and doing undergrad here. he does not have bank balance. can he apply GC for parents. I thought he need good bank balance to prove that he can support them That is the reason we wanted to apply for visitor visa.

            A co-sponsor is allowed if the petitioner does not have enough funds. also your bro has to be 21+ to file.
            Please read the I-864 form instructions( affidavit of support for immigrant visas) , it explains everything in detail about co sponsorship.

            I also advise you to consult a GOOD attorney before filing I-130 in case there are issues regarding her old green card that may affect the new petition. If you can afford it, you can do the I-130 filing through the attorney, he will take care of all I-864 issues.
